Dear Mr. Kappes:
This letter is to inform you that on February 14, 1989, during
the regular meeting of the Albemarle County Board of Zoning
Appeals, your application for VA-88-92 was approved subject to the
condition that it run with the campground use.
This variance approval allows relief from Section 30. 5. 6. 2 . 1 of
the Albemarle County Zoning Ordinance to reduce the building
setback in the Scenic Areas-Highway Overlay District from the
required measurement of one hundred fifty (150) feet to one
hundred thirty-six (136) feet.
Please note that according to Section 35. 0 of the Zoning
Ordinance, the applicant is responsible for paying any expenses
incurred by the County during the processing of the application.
Therefore, you are required to reimburse the County for $8 . 80.
The attached invoices shows a list of expenses.

STAFF REPORT - VA-88-92
APPLICANT: Werner G. Rappes
TAX MAP/PARCEL: 71/3
ZONING: RA (Rural Areas)
LOCATION: South side of Rt. 250 West, + .3 mile
west of its intersection with Rt. 689.
The applicant seeks a variance from Section 30.5.6.2. 1 of the Albemarle
County Zoning Ordinance, which states:
"30.5.6.2 SA-Highways
30.5.6.2. 1 No buildings or structures other than permitted under
Section 4. 11, except as hereafter provided in the case
of certain signs, shall be constructed within any SA-highways
overlay district . . ."
The Scenic Highway District is established in Section 30.5.2.2, which states:
"30.5.2.2 SA-HIGHWAYS
SA-Highway overlay districts are hereby established along the following
highway corridors in Albemarle County for a distance of one hundred fifty
(150) feet on each side of the right-of-way:
a. U.S. Route 250 from the western corporate limits of the City of
Charlottesville to the western Albemarle County border."
The owner/applicant proposes to construct an addition of 420 sq. ft. to
be attached to the east side of the structure which houses the manager's
residence and store.
A 136 foot setback is the distance at which the existing building is located.
The applicant wishes to erect the proposed addition in line with the present
structure, thus requiring a fourteen (14) foot variance. The two (2) options
in regard to an addition would be to add to either the east or north sides
of the building.
This application is both a reduction in size of a proposed addition and
substantial in setback considering the previous request made via the applicant.
The staff finds that practical difficulties exist in regard to adding any
addition to the existing building. Such a substantial right-of-way width
of 110 feet in itself produces an appearance of additional setback, especially
the measured distance from the existing road pavement. An honest effort
has been made in this effort to match the proposed addition to the existing
building.

RECOMMENDATION
The application should be approved for cause:
1) The ordinance requirements have created a hardship and hinder the applicant
in a reasonable development of the property.
2) The hardship is generally unique to property within the scenic overlay
district. Other properties may experience the same circumstances.
3) The granting of the variance should not be detriment to the adjacent
properties nor will the character of the district be changed by the
granting of the variance.
