Dear Mr. Tucker:
This letter is to inform you that on January 17, 1989, during
the regular meeting of the Albemarle County Board of Zoning
Appeals, the Board heard your application for VA-88-93 . The Board
ruled to grant your variance request from Sections 4 . 15. 3 . 5 and
20.8. 6 of the Albemarle County Zoning Ordinance to increase the
allowable sign area for an identification sign from two (2) square
feet to fifty (50) square feet and to reduce the setback for the
sign from the minimum required measurement of thirty (30) feet to
one (1) foot with the condition that the applicant pay for moving
the sign if the road changes.

The applicant seeks a variance from Sections 4. 15. 3 .5 and 20. 8. 6
of the Albemarle County Zoning Ordinance, which states:
"4 . 15. 3 Permitted Signs
4 . 15.3 .5 . . . . Planned Unit Development (PUD)
Identification Signs: Provided: (a) not more than
two (2) square feet in area . . .
20. 0 Planned Unit Development (PUD)
20.8. 6 Setback and Yard Regulations
•Within the PUD district, the Board of Supervisors
shall establish minimum setback and yard requirements
at time of establishment of such district.
The applicant proposes to erect an identification sign and seeks a
variance to increase the allowable sign area from two (2) square
feet to fifty (50) square feet and to reduce the setback for
the sign from the required measurement of thirty (30) feet to one
(1) foot.
The Planned Unit Development (PUD) Section of the Albemarle County
Zoning Ordinance provides for commercial areas to be created
within the PUD. However, when the signage limitations of Section
4. 15. 3.5 are reviewed, the only business signs provided for are
wall signs having an aggregate area of twenty (20) square feet.
No provision is made for a freestanding sign. The signage
issue within Planned Developments is being reviewed and amendment
recommendations will be forthcoming in the next several months.
RECOMMENDATION
The staff believes that the applicant's hardship is that the
Zoning Ordinance allows for the commercial use, but in turn does
not provide for adequate signage to identify the business. The
staff recommends that the variance be granted for a fifty (50)
square foot, externally illuminated sign.
