This variance approval allows relief from Sections 4 . 1. 3 and 10. 4 of the Albemarle County Zoning Ordinance to decrease the minimum area required for a parcel not served by neither a central water or sewer system from sixty thousand (60, 000) square feet to forty-three thousand five hundred sixty (43, 560) square feet, to decrease the minimum lot size for the parcels from two (2) acres to one (1) acre and one and seven tenths (1.7) acres and to decrease the minimum frontage from two hundred fifty (250) feet to one hundred (100) feet for each parcel. Burgess, Jr. Zoning Administrator CWBJr/st cc: VA-88-94 Planning Department STAFF REPORT - VA-88-94 OWNER: Anthony and Charles Dunivan TAX MAP/PARCEL: 45/56 ACREAGE: 2.7 Acres ZONING: Rural Areas (RA) LOCATION: West side of Route 643, _+ .7 miles south of its intersection with Route 743. The applicant seeks a variance from Sections 4. 1.3 and 10.4 of the Albemarle County Zoning Ordinance which state: "4. 1.3 For a parcel served by neither a central water supply nor a central sewer system, there shall be provided a minimum of sixty thousand (60,000) square feet per commercial or industrial establishment or per dwelling unit as the case may be. 10.4 Area and Bulk Regulations Minimum lot size 2 Acres Minimum frontage existing public roads 250 feet" The applicant at present has two (2) single family dwellings located on a two and seven tenths (2.7) acre parcel and desires to divide the property so as to locate each of the dwellings on a separate parcel. In an effort to accomplish this, the applicant seeks the following variances: 1) To reduce the minimum area for a parcel not served by a central water or sewer system from the required sixty thousand (60,000) square feet to forty three thousand five hundred sixty (43,560) square feet, 2) To reduce the minimum lot size for the two (2) parcels from the two (2) acre requirement to one and seven tenths (1.7) acres and one (1) acre, and 3) To reduce the minimum frontage for the proposed parcels from the required two hundred fifty (250) foot measurement to one hundred (100) feet each. As stated, the owner at present has two (2) single family dwellings located on one parcel and desires to divide the property so as to provide individual ownership for each dwelling. In that the dwellings presently exist, the staff is of the opinion that the granting of the variance requests would not be of detriment to the adjacent property owners nor would the character of the district be altered. RECOMMENDATION The staff recommends that the variance requests be granted subject to Health Department approval of septic field locations.
