Dear Mr. Bowles:
This letter is to inform you that on February 14, 1989 , during
the regular meeting of the Albemarle County Board of Zoning
Appeals, your application for VA-88-95 was approved for the sign
sketch presented subject to 40 square foot maximum, setback of
one (1) foot, and to be externally illuminated.
This variance approval allows relief from Sections 4 . 15 . 3 . 5 and
20. 8. 6 of the Albemarle County Zoning Ordinance to increase the
allowable sign area for an identification sign from two (2) square
feet to forty (40) square feet and to reduce the setback for the
sign from thirty (30) feet to one (1) foot.
Please note that according to Section 35. 0 of the Zoning
Ordinance, the applicant is responsible for paying any expenses
incurred by the County during the processing of the application.
Therefore, you are required to reimburse the County for $9. 05.
The attached invoices shows a list of expenses.

STAFF REPORT - VA-88-95
APPLICANT: Atlantic Coast Athletic Club
TAX MAP/PARCEL: 61X2/4D
ZONING: Planned Unit Development (PUD)
LOCATION: 200 Four Seasons Drive
The applicant seeks a variance from Sections 4. 15.3.5 and 20.8.6 of the
Albemarle County Zoning Ordinance, which state:
"4. 15.3 Permitted Signs
4. 15.3.5 . . . Planned Unit Development (PUD) Identification Signs:
Provided: (a) not more than two (2) square feet in area

20.8.6 Setback and Yard Requirements
within the PUD district, the Board of Supervisors shall
establish minimum setback and yard requirements at time
of establishment of such district. "
The applicant proposes to erect an identification sign and seeks a variance
to increase the allowable sign area from two (2) square feet to forty (40)
square feet and to reduce the setback for the sign from the required measurement
of thirty (30) feet to one (1) foot. At present, a twenty (20) square foot,
non-conforming sign exists at the approximate location where the applicant's
sign is to be erected.
The Planned Unit Development (PUD) section of the Albemarle County Zoning
Ordinance provides for commercial areas to be created within the PUD. However,
when the signage limitations of Section 4. 15.3.5 are reviewed, the only
business signs provided for are wall signs having an aggregate area of twenty
(20) square feet. No provision is made for a freestanding sign. The signage
issue within Planned Developments is being reviewed and amendment recommendations
will be forthcoming in the next several months.
RECOMMENDATION
The staff believes that the applicant's hardship is that the Zoning Ordinance
allows commercial type uses in specified areas of a Planned Unit Development
(PUD) , but in turn does not provide for adequate signage to identify the
businesses. The staff recommends that the setback for the sign be reduced
from thirty (30) feet to one (1) foot, that the size of the sign not exceed
twenty (20) square feet, and that the sign be externally illuminated.

Mr. Evans read the staff report.
VA-88-95. Atlantic Coast Athletic Club (owner) , property known as
tax map 61X2 , parcel 4D, located at 200 Four Seasons Drive, zoned
PUD. The applicant seeks a variance from Sections 4 . 15.3 .5 and
20.8. 6 of the Albemarle County Zoning Ordinance to increase the
allowable sign area for an identification sign from two (2) square
feet to forty (40) square feet and to reduce the setback for the
sign from thirty (30) feet to one (1) foot. (See the attached
copy of the staff report. )
George Bowles, Manager of the club, stated he took the comments
from the previous meeting and modified the request and came up
with the new proposal which he showed the Board.
Mr. Evans read a letter from Jan Sprinkle which stated she had
seen the revised sign proposal and withdrew her original
complaint.
The Chairman invited pubic comment.
There being no further comment, the matter was placed before the
Board.
Mr. Evans stated the sign would have to be reduced two square feet
because it was only advertised for a maximum of 40 square feet.
Mr. Van Fossen moved that the sign presented to them be approved
subject to 40 square foot maximum, that the setback be reduced to
1 foot, and the sign be externally illuminated.

Mr. Evans stated that Mr. Train had asked to have the application

Mr. Van Fossen made a motion to defer the application to the
Board's next meeting.
Mr. Rennolds seconded the motion, which was unanimous.
The next application before the Board was VA-89-2, Central
Fidelity Bank.
Mr. Evans read the staff report.
VA-89-2. Central Fidelity Bank (owner) , property known as tax map
32 , parcel 37B1, located on the southwest corner of Route 29 and
Route 649, zoned C-1. The applicant seeks a variance from Section
21.7. 1 of the Albemarle County Zoning Ordinance to reduce the
setback for a free-standing business sign from the required thirty
(30) foot measurement to one (1) foot. (See the attached copy of
the staff report. )
Woody Palmore, representative of Central Fidelity Bank out of
Richmond, stated their new branch would be completed in a few
days, and they were requesting the variance for the location of
their new sign.
Mr. Evans stated that future development plans for the highway was
the reason for the radical angle of the front property line.
