Burgess, Jr. Zoning Administrator Department of Zoning County of Albemarle 401 McIntire Road Charlottesville, Virginia 22901 Re: File #VA-89- 1 Dear Mr. Burgess, Thank you for the extension granted to my variance request. I did not realize that there would be such a large backlog and my schedule required me to take a flight that afternoon. I am late in writing this response to your staff report, but would like to get it in anyway. In your summation I would like to correct several items which were included either by me in my filing or in your review. The variance request is for a 7.4 foot encroachment or 67.6 feet. I had this surveyed to determine the actual distance other than a my original guess. The site while 5.3 acres is largely unbuildable. Its asset is of course the view. Due to the slope of the northern side and the placement of well and acceptable septic field areas the site is excessively restrictive. In siting the house I had planned on a series of outbuilding and additions. These are to be tightly grouped within the triangle created by the property lines and the setbacks. This particular outbuilding was not originally planned, and therefore had not appeared on the site plan submitted for construction. Its need appeared to us during construction. 1 plotted it without referencing the site plan or setbacks, but in its axial relationship Burgess, page 2. to the proposed Master wing of the house and the garden. I checked its distance to Route 682. This is where my problem began. I inverted the set backs mentally as assuming the front yard to be Mechums West, which the House addresses. The closeness (i.e, less than 75 though greater than 60) was called to my attention by the building inspector, I then called your office to verify and filed for a variance of the 75' Route 682 setback. I did not want to invert or reverse the setbacks. Upon realzing my placement error in relation to the siting of the house and garage, this would not work. Therefore the request is simply a variance of 7.4 feet of 75. In your recommendation to deny you listed three points. Point one is answerable on two points. I ) I have constructed the structure, it will be difficult to move. And, 2) most important to me, the proper siting relationship of the various structures within a balanced hierarchy. The new site plan is included to illustrate this. Point two and three are similar statements, again two points. I ) The site configuration as such, discussed above, is difficult. 2) Throughout the county 75 feet is not a consistent setback and particularly on my road. I don't think that an 8' wide outbuilding will be percieved as physically imposing on rural qualities, if not a condition one would percieve as rural (i.e farm house and outbuildings. What can one say is rural or not about it, it makes no macro gestures to an urbanity of the street but to a micro assemblage of structures on the land. Rural in your case is a broad term but I believe it intentions relate to that perception of qualities. I have a 6' solid wood fence across the street, built to the property line along 682. This is not rural but quite urban and far more visually "noticeable." I do not want to belabor your points but I find it quite impossible to systematically or categorically answer either. I just cannot spend the time I think it would take. I ask that you reconsider the staff report. Thank you.
