Dear Mr. Palmore:
This letter is to inform you that on February 14, 1989, during
the regular meeting of the Albemarle County Board of Zoning
Appeals, your application for VA-89-2 was granted with the
condition that the staff review the sign.
This variance approval allows relief from Section 21.7 . 1 of
the Albemarle County Zoning Ordinance to reduce the setback
for a free-standing business sign from the required thirty
(30) foot measurement to one (1) foot.

LOCATION: On the Southwest corner of the
Intersection of Rt. 29 and Rt. 649
The applicant seeks relief from section 21.7. 1 of the Albemarle County Zoning
Ordinance, which states:
"21.0 Commercial District - Generally
21.7 Minimum yard Requirements
21.7.1 Adjacent to public streets: No portion of any structure except
signs advertising sale or rental of the property shall be erected closer
than thirty (30) feet to any public street right-of-way."
The applicant proposes to erect a new business sign one (1) foot from the
road right-of-way, a variance of twenty nine (29) feet from the required
thirty (30) foot setback. A new and permanent building is under construction
and will replace the present mobile office trailer that has been used since
the early 70's.
The site is being redone in respect to parking and access. Incorporated
in the development involves landscaping and the potential for highway improvements.
Special note is made in reference to the radical angle of the front property
line (Rt. 29 side) , which affects the required thirty (30) foot setback
for structures which includes signs.
Only a small portion of the southeast island front could be used to locate
a sign and meet the thirty (30) foot setback. Again, trying to utilize
the Airport Road (Rt. 649) frontage to locate a sign, the thirty (30) foot
setback is beyond the approved parking area.
RECOMMENDATION
The application should be approved for cause:
1) The zoning ordinance requirements create a hardship, and cause the applicant
difficulty in a reasonable development of the property.
2) The hardship is generally unique to this corner commercial property.
3) Granting of the variance should not be of any detriment to the adjacent
properties, and the character will not be changed by the granting of
the variance.
