Dear Mr. & Mrs. Gruss:
This letter is to inform you that on February 14, 1989, during
the regular meeting of the Albemarle County Board of Zoning
Appeals, your application for VA-89-5 was approved subject to the
following conditions:
(1) Limit of one (1) free-standing sign to the property.
(2) The sign, if lighted, should be by external source, and
(3) Sign material should be of wood material.
This variance approval allows relief from Section 10. 4 of the
Albemarle County Zoning Ordinance to reduce the setback for a
free-standing business sign from the required seventy-five (75)
foot measurement to ten (10) foot.

LOCATION: West side of Rt. 743 + .3 mile south of
its intersection of Rt. 663.
The applicant requests relief from Section 10.4 of the Albemarle County
Zoning Ordinance, which states:
"10.4 AREA AND BULK REGULATIONS
Yards, minimum:
Front . . . 75 feet."
The applicant wishes to erect a free standing business sign at the distance
of ten (10) feet from the property line or road right-of-way, thus requiring
a sixty-five (65) foot variance. The seventy-five (75) foot setback requirement
is affected in the applicant's situation because a dual measurement from
both State Route 743 and the fifty (50) foot access easement which serves
as entry to the applicant proposed animal hospital has to be met. The applicant
voluntarily offered to indicate a seventy-five (75) foot setback from Rt.
743 from approximately the building location parallel with the curvature
of the road (Rt. 743) toward the access easement.
Reviewing the site the staff finds that a hardship is prevalent because
of the limited road frontage and the abutting Union Church property that
physically separates the applicant's property from Rt. 743. Other properties
may experience similar difficulties.
RECOMMENDATION
The application should be approved for cause with conditions.
*Note - The sign could be reduced in size, due to the ten (10) foot setback.
