JUSTIFICATION FOR REQUEST: The Applicant has been in contact with the County Building and Fire Officials. As a result, he is under the opinion that there are special circumstances in his particular case which would be supportive in justifying the existing water flow conditions as adequate for fire protection. • The foregoing information is complete and correct to the best of my knowledge. Alternative Fire Protection Measures: Section 32 .7. 6 FIRE PROTECTION requires that hydrant flow be as prescribed by ISO. On several occasions in the past, the Fire Official has recommended alternative measures intended to equally satisfy or exceed such requirements. In this particular case, the Fire Official has recommended that a sprinkler system together with available fire hydrant flow would provide equivalent or superior protection. Section 32. 3 . 11. 1 of the Zoning Ordinance states that: 32 .3 . 11 WAIVER, VARIATION, SUBSTITUTION 32.3 .11. 1 The commission may waive, vary or accept substitution for any requirement of Section 32 .7, minimum standards for improvements, in a particular case upon a finding that requirement of such improvement would not forward the purposes of this ordinance or otherwise serve the public interest; or in the case of substitution, that such alternative will satisfy the purpose of this ordinance to at least an equivalent degree as the requirement improvement. (Added 5-1-87) . 3 . SUMMARY: The Code of Virginia outlines fire protection as a requirement and responsibility of zoning. Zoning densities are not guaranteed; requirements of 32 .0 SITE DEVELOPMENT PLAN must be satisfied. Alternate fire protection measures are available which would permit development as proposed. Also, the applicant could modify the plan to meet existing flow conditions. STAFF RECOMMENDATION: The Director of Inspections (as Fire Official) has recommended disapproval of this waiver request (See Attachment B) . Staff opinion is that conditions imposed by the Planning Commission in approval of a site plan are intended to be essential to and non severable from the action to approve. Since the applicant is unwilling to comply with a specific condition of approval, with the minimum requirements of 32.7. 6 FIRE PROTECTION, and since the applicant's proposal does not satisfy the requirements of 32.3 . 11. 1, Staff recommends denial of the Greens at Hollymead Site Plan. NOTE: Should the Planning Commission deny this site plan, the applicant may appeal to the Board of Supervisors in accordance with Section 32 .3 . 10 APPEALS of the Zoning Ordinance. 2 474.c.- eml"- A SITE REVIEW COMMENTS - THE GREENS OF HOLLYMEAD 1) The following items are required to be submitted by the revision deadline if the above-noted site plan is to proceed to Planning Commission review: a) As staff mentioned at Site Review, please submit in writing, or graphically illustrate how the residue acreage of parcel 26B will have access. We had discussed a number of access options at Site Review; b) If the applicant proposes any off-site grading, please submit a letter(s) of easement from adjacent property owners authorizing the applicant to perform such activity on adjacent parcels; c) Please submit an updated density plan indicating the proposed shift in unit density from an adjacent parcel to parcel 26B; d) Please provide a pedestrian walkway system for this development. Walkways enabling pedestrians to walk safely and conveniently shall be provided, while allowing access to open space and recreation areas; e) Staff would recommend that a sidewalk be installed from the recreation area to Powell Creek Drive. Since it is likely that the entrance of this development could be a potential bus stop, staff would recommend that an area be reserved for this purpose; f) Staff suggest that the applicant consolidate the for buildings 1, 2, and 3 . Consolidation of these entrances would reduce the amount of friction on the internal road when entering the development; g) Please contact Jay Schlothauer in the Inspections Department to discuss further options for meeting fire protection requirements for this development. Hurt - Director of Inspections /,• DATE: January 20, 1989 RE: The Greens at Hollynmead - Request for wavier from Fire Flow Requirements Mr. David Wilderman of Case Edwards Development, Inc. is requesting a wavier from the Planning Commission as to the fire flow requirements (GPM) for the above site. The actual fire flow at this site is 1500 GPM. The required fire flow is 2750 GPM for Building 13/14. If fire separation is provided between Building 13/14, then the required fire flow may be reduced to 2000 GPM. The required fire flow for the rest of the buildings is 2000 GPM. I would not recommend a wavier because Section 32 . 7 . 6 . 1 of the Zoning Ordinance states that the fire flow requirements shall be as prescribed by ISO Standards. Also, this Section states that the Fire Official may require such alternative provisions as deemed necessary to provide adequate fire protection. The alternative protection that I required was two options: 1. Install sprinklers in accordance with NFPA-13 and NFPA-13D or 2 . Provide fire separation (floor, ceiling, walls) between units.
