This variance approval allows relief from Section 10.4 of the Albemarle County Zoning Ordinance to reduce the front setback for a dwelling from the required seventy-five (75) feet to forty-eight (48) feet. Burgess, Jr. Zoning Administrator CWBJr/st cc: VA-89-10 Inspections Department STAFF REPORT- VA-89-10 APPLICANT: Donald Lucero TAX MAP/PARCEL: 33/34A ACREAGE: 4 . 968 acres ZONING: Rural Areas (RA) LOCATION: West side of Route 600, + .8 miles south of its intersection with Route 747. The applicant seeks a variance from Section 10.4 of the Albemarle County Zoning Ordinance, which states: "10.4 AREA AND BULK REGULATIONS YARDS, MINIMUM: Front . . . 75 feet. " The applicant proposes to construct an addition on the south side of the existing dwelling and seeks a reduction of the front yard setback from the required measurement of seventy-five (75) feet to forty-eight (48) feet. The existing dwelling was constructed in 1966 and has a front setback of forty-eight (48) feet. The applicant's only alternative to construct an addition without benefit of a variance would be to attach said addition to the rear of the dwelling. RECOMMENDATION The dwelling was constructed prior to the adoption of any Zoning Ordinance in Albemarle County. Now the dwelling is viewed as being non-conforming due to the front setback. Continuing the existing building line will not be of detriment to the adjacent properties nor will the character of the district be altered. The applicant's request should be approved.
