Dear Mr. Maynard:
This letter is to inform you that on June 13, 1989, during the
regular meeting of the Albemarle County Board of Zoning Appeals,
the Board ruled to allow your application for VA-89-11 to be
withdrawn.
A sign permit application is enclosed for your convenience for the
proposed menu board sign.

VA-89-11 DARRELL V. MAYNARD (ADDENDUM)
The variance request was deferred from the March 14, 1989 meeting
to the May 9, 1989 meeting and from the May 9, 1989 Board meeting
until this date, to allow additional information to be provided.
It was recommended that the applicant consider a sign design which
combines the three (3) requested free-standing signs into one (1)
sign. No information has been submitted to date by the applicant.
Since the prior Board of Zoning Appeals meeting, two letters of
objection have been received (attached) .
In accordance with the Board's request, a summary of signage on
this property has been compiled. It is as follows:
1. S-87-65 was approved in October, 1987 for the Jefferson
Area Board for Aging. The free-standing sign was located
in place of a previous sign for Preston Stallings. The
wooden sign consisted of two parts: 19 inches by 42 inches
and 12 inches by 42 inches. (Total approximately 9 square
feet)
2 . S-88-108 was approved in November, 1988 for Olde Towne
Financial. This fiberglass sign consisted of 16 square feet
of area.
3 . S-88-118 was submitted in December, 1988 for Mutual of
Omaha. The proposed wooden sign will be 15 square feet
of area.
Staff's position remains that this request should be denied for
cause.

The applicant seeks a variance from Section 4 . 15. 3 . 6 and 21. 7 . 1 of
the Albemarle County Zoning Ordinance, which state:
"4 . 15 SIGNS:
4 . 15 . 3 . 6 Commercial (C-1)
Business signs, free standing .
(d) no more than two (2) free-standing signs on any one (1)
lot or premises;
21. 7 Minimum Yard Requirements
21. 7 . 1 Adjacent to public streets: no portion of any
structure except signs advertising sale or rental of the
property shall be erected closer than thirty (30) feet to any
public street right-of-way. "
The applicant seeks a variance to increase the number of free
standing business signs from two (2) signs to three (3) signs and
to reduce the setback for said signs from the required measurement
of thirty (30) feet to eight (8) feet. The aggregate area of the
three (3) signs would be forty (40) square feet. An aggregate
sign area of fifty (50) square feet is allowed in a commercial
(C-1) district for free standing business signs.
The applicant states that the signs would not be readily visible
to passing motorists if forced to comply with the required
setback. The applicant also cites that by complying with the
required setback, the signs would then be within five (5) feet of
the building and would thereby detract from the building's
aesthetic quality.
RECOMMENDATIONS
The applicant's requests as presented should be denied. However,
the staff could support some reduction of the required setback if
the applicant were to combine the three (3) signs into one (1)
sign structure.
