MEMORANDUM

RE: Hollymead Racquet & Fitness Center
VA-89-12
The above listed owners are applying for a variance from Section
32 .7. 6 of the Zoning Ordinance to waive the fire flow requirements
as prescribed by ISO standards.
The required fireflow for this site is 1750 gpm. The 8" water
line available to serve the site provides 1100 gpm. Therefore,
the required fireflow cannot be achieved without certain
alternatives.
1. Without sprinkling the entire building or building firewalls,
the lowest fireflow requirement is 1750 gpm @ 20 psi.
2 . With a 2 hour firewall between the tennis barn and the
auxiliary areas, the lowest fireflow requirement is also 1750 gpm
@ 20 psi.
3 . With a firewall separating the tennis barn from the auxiliary
areas, and firewalls between each of the three tennis courts, the
lowest fireflow requirement is 1000 gpm @ 20 psi.
4. In a situation similiar to #3 with the tennis barn separated
into a 2 : 1 combination, the lowest fireflow requirement is 1500
gpm @ 20 psi.
In accordance with Section 32 .7. 6. 1 of the Zoning Ordinance, the
fire official may require such alternative provisions as deemed
reasonably necessary to provide adequate fire protection.
The owners must either sprinkle the entire building or provide
firewalls as prescribed in alternative #3 .
The 8" water line could be increased to a larger size line. The
hydrant is located just on the other side of Hollymead Drive and
the water line could very easily be increased in size.
I recommend to the Board of Zoning Appeals to not grant a variance
because this structure would not have adequate fire protection.

miles east of its intersection with
Route 29 .
The applicant seeks a variance from Section 32 . 7 . 6 . 1 of the
Albemarle County Zoning Ordinance, which states:
"32 . 0 SITE DEVELOPMENT PLAN
32 . 7 MINIMUM STANDARDS FOR IMPROVEMENTS
32 . 7. 6 FIRE PROTECTION
32 . 7 . 6 . 1 In areas where public water is deemed
reasonably available by the commission, fire
hydrants and distribution systems shall be
provided by the developer. Hydrant locations
and fire flow requirements shall be as
prescribed by Insurance Service Offices (ISO)
standards and subject to approval of the
Albemarle County fire official . Access ways
for emergency vehicles shall be provided as
specified by the fire official . In areas where
public water is not reasonably available, the
fire official may require such alternative
provisions as deemed reasonably necessary to
provide adequate fire protection. "
The applicant proposes to enclose three (3) tennis courts with a
metal structure and seeks a variance of the fire flow requirements
of the Insurance Service Offices (ISO) standards which are the
referenced requirements of section 32 . 7 . 6. 1 of the Albemarle
County Zoning Ordinance. Specifically, the applicant seeks a
reduction of the required fire flow from one thousand seven
hundred fifty (1750) gallons per minute to one thousand one
hundred sixty-five (1165) gallons per minute. The applicant
requests the variance on the basis that the enclosure will be
constructed of non-ccmbustable materials and that the contents of
the structure will also be non-combustible.

It should also be noted that Section 32 . 7 . 6. 1 of the Albemarle
County Zoning Ordinance is subject to waiver and/cr variation by
the Planning Commission as stated in Section 32 . 3 . 11. 1, to wit:
"32 . 3 . 11 WAIVER; VARIATION; SUBSTITUTION
32 . 3 . 11. 1 The commission may waive, vary or accept
substitution for any requirement of section
32 . 7, minimum standards for improvements in a
particular case upon a finding that
requirement of such improvement would not
forward the purposes of this ordinance or
otherwise serve the public interest; or in
the case of substitution, that such
alternative will satisfy the purpose of this
ordinance to at least an equivalent degree as
the required improvement. "
RECOMMENDATION
The staff recommends that the request be denied for cause:
1) The applicant has not shown that a strict application of the
Zoning Ordinance would cause a clearly demonstrable hardship
approaching confiscation as distinguished from a special
privilege or convenience.
2) The applicant has not demonstrated that the perceived
hardship is not generally shared by other properties in the
general vicinity or same zoning district.
3) The applicant has not shown that the granting of the variance
request would not be of substantial detriment to the adjacent
properties or that the character of the district would not be
altered.
