Request for Variance of Fire Protection
Dear Mr. Burgess:
Request for Variance of Section 32.7.6 of the Albemarle County
Zoning Ordinance:
"In areas where public water is deemed reasonably
available....fire flow requirements shall be as prescribed
by ISO Standards, and subject to approval of Albemarle County
Fire Official."
According to the ISO Chart used by the County Inspections
Department, the required fire flow for the site is 1750 gpm. Based
on Site Plan submitted 1/23/89, as reviewed by staff for a 4,500 S.F.
"Auxiliary Building" and a 19,000 S.F. "Tennis Barn".
The 8 water line available to serve the site provides a 1,100 gpm
fire flow. Since the required fire flow cannot be achieved alternative
fire protection provisions must be provided.
The owner agrees to provide a fire wall between the Auxiliary
Building and the Tennis Barn. The fire protection requirement is
based on the building size, construction and use.
There are two separate uses included in the proposed development:
(1) The "Auxiliary Building at ± 4,500 S.F. with pro-shop &

fitness center, if considered alone only required 750 gpm
if non-combustible.
(2) The "Tennis Barn" at ± 19,000 S.F. consisting of non-
combustible construction material would require
1,750 gpm. Its use being tennis courts, with contents
being the space to play tennis.
The Auxiliary Building separated from Tennis Barn has adequate
fire flow.
The Tennis Barn cannot meet fire flow so the required fire flow
protection must meet the zoning code:
"provisions as deemed reasonably necessary to provide
adequate fire protection "
Justification for this request for variance is based on the construction
material and use of this proposed structure. The materials shall be
non-combustible and the use shall be limited to tennis use.
The owner shall provide a letter that, should this variance be
approved, the use of the "Tennis Barn" shall be restricted to tennis
use; and the additional Fire Protection provisions are required should

I have met with Jay Schlothauer, Bob Jenkins, and Charlie Burgess,
Zoning Administrator to discuss this request to modify regulations
regarding fire protection. It was decided that the best route to take
is to request a variance from the Board of Zoning Appeals.
Attached is a copy of letter to Charlie Burgess for your use.
Please notify me of your recommendation to Charlie Burgess and
BZA, and do not hesitate to call me if you need further information in
your review.
