Mr. William Schwab, the builder, addressed the Board and said he was appearing on behalf of the owner of the property. He said the property adjacent to this property had a variance granted for its garage. He said the garage he proposes to build would butt up on the property line, near the garage existing on the adjacent property. Mr. Schwab said the slope of the lot and the location of the septic system required that the house be located exactly where it is. He said the setback required from the cul-de-sac makes it difficult to locate the garage. The septic field is located on the other side of the property and the slopes would also prohibit the constuction of a garage. Mr. Schwab said it would be very impractical to build a garage further back on the property, but it could be done. It would probably require a full foundation, would disturb ground that was left undisturbed by the construction of the house and would require the removal of trees. He said neither he nor the homeowner wished to do that. Mr. Schwab then described the design of the garage, emphasizing that the siding and roof line would match that of the house. Ms. Huckle asked if the garage could be located in the basement. Mr. Schwab said the basement was finished and could not house a garage. Ms. Huckle said the house could have been designed to accomodate a garage. Mr. Schwab said the driveway would have been extremely steep. Mr. Kennedy asked if the applicant planted to locate the garage on the cul-de-sac to avoid disturbing some ground and removing some trees. Mr. Schwab repeated that the slope of the property made placing a garage within the required setbacks impractical. Mr. Kennedy asked why the garage could not be located closer to the house. Mr. Schwab said that would require a full foundation and the garage still would not meet the required setback. He said the front of the house lies on the setback line. Mr. Kennedy said it appears to him that there is no place on this property to build a garage, unless it could be built behind the house. Mr. Schwab said the property was too steep to allow a garage to be built behind the house. Mr. Schwab said the property across the cul-de-sac from the applicant was owned by Colonel White and he does not think these lots will ever be built on. He said the proposed garage would be visible to the owners of only three properties. He said he would suggest to the owner of the property that the design of the garage be submitted to these three or four owners for their review and approval before the garage is built. Mr. Kennedy asked if anyone present opposed the request. Mr. Lawrence Groves addressed the Board and said he owns the adjacent property to the west of Mr. Schwab 's lot. He said he opposed this request because it would upset the harmony of the neighborhood by placing a very large structure right on the road. He said the garage might lessen the value of his property and that of his neighbors. He said Mr. Schwab chose to build on a very difficult lot. He said a garage might have been incorporated into the plans for the house had Mr. Schwab decided earlier that he wanted a garage; Mr. Schwab may have put himself in a difficult position with respect to building the garage. Mr. Groves said the proposed garage is an afterthought. He said he thinks the new owners of the property are investigating the possibility of whether a variance could be granted; he does not think they are in a hurry to build the structure. He noted that no concrete, detailed building plans are available. A member of the Board asked Mr. Groves if he had a variance for the garage on his property. Mr. Groves said he is the third owner of the property and does not know if a variance was granted or not. Mr. Evans said there was no record of a variance being granted for this property. Mr. Groves said that when he bought the property, his lawyer advised him of the 50-foot building setback but could find no record of a variance. He said he thinks the the house and garage are about 10 - 12 years old. Mr. Roger Ritter addressed the Board and said he lives in the house across the street. He said he opposed the reduction in setback without knowing exactly what the garage will look like. He said the proposed garage would be much closer to the road than is anything else in the neighborhood. He said that Mr. Schwab has built a beautiful house and, if his intentions are carried out, the garage would be attractive, too. Nevertheless, he would still like to see the garage built further back. He said he does not want to depend on the interests of a new owner or give the new owner carte blanche to build whatever he wants that close to the road. A member of the Board asked how many of the houses in this area do not have garages. Mr. Ritter said three of the five property owners on the street have garages, but some of them are attached. Mr. Richard Lyng, who owns lot 3 , addressed the Board. He said he is relieved that the garage cannot be built near his property line. He said he opposes the proposed garage for economic reasons. He thinks that building the garage eleven feet from the cul-de-sac would impair the value of his property. He said he intends to sell his house within a year and does not want to see any detriment to the value of the home. Since no one else wished to address the Board, Mr. Kennedy closed the public hearing and placed the matter before the Board. Ms. Huckle said she thinks this request for a variance is matter of convenience to the owner rather than hardship. Mr. Rennolds said that other houses in the neighborhood do not have garages. He said he agrees with Mr. Lyng that the proposed garage would be sitting right at the edge of the cul-de-sac. He said he personally feels that this request should be denied. Mr. Rennolds then moved that the request be denied. Ms. Huckle seconded the motion. The role was called, with all members voting "Aye" .
