Dear Mr. Purcell:
This letter is to inform you that on April 11, 1989, during
the regular meeting of the Albemarle County Board of Zoning
Appeals, your application for VA-89-16 was approved with the
conditions that each lot retain 210 feet of road frontage
and that they share a common entrance to the two lots.
This variance approval allows relief from Section 10. 4 of
the Albemarle County Zoning Ordinance to reduce the lot
frontage on a public road from the required measurement of
two hundred fifty (250) feet to two hundred ten (210) feet
to allow the replatting of the property.

APPLICANT: R. G. Purcell & Daughters Land &
Development Corporation
TAX MAP/PARCEL: 123/27A
ZONING: RA (Rural Areas)
LOCATION: Located on east side of Rt. 618, +/- . 5 miles
south of its intersection with Rt. 761
The applicant requests relief from Section 10. 4 of the Albemarle
County Zoning Ordinance, which states:
"10.4 AREA AND BULK REGULATIONS
REQUIREMENTS
Minimum lot size 2 acres
Minimum frontage
existing public
roads 250 feet
Minimum frontage
internal public
or private roads 150 feet"
The applicant wishes to replat two (2) existing lots, and by
doing so ask for a reduction from the required two hundred
fifty (250) feet of road frontage, to two hundred ten (210) feet,
a variance of forty (40) feet, for each of the two (2) lots.
The applicant has two (2) lots, which consists of two (2) acres,
and one (1) acre respectively. Both lots front on
State Route 618 and have two hundred ten (210) feet of road
frontage each. The common property line between the two (2) lots
will be relocated to provide each lot with two (2) acres of area.
Reference is made to the Planning Department's memo regarding
their comments about the VA-89-16 application. It is true that
a variance is being sought because of the replatting of the
property, but relocating the mutual property line will not
actually effect the existing two hundred ten (210) foot road
frontage of either lot. The common property line between the
two (2) lots will be relocated to establish the proposed two
(2) acre lots.
The following comments are offered to the Board of Zoning
Appeals in consideration of the requested application:

A) The review of the history records indicate that the two (2)
lots have been in existence prior to any zoning (1968) in the
County. A strict application would produce a hardship in
trying to produce two (2) lots from the existing ones that
fully qualify under the present Ordinance requirements. I
believe that maintaining the existing road frontage, balancing
the two (2) acres per lot, providing adequate building area
(30, 000 square feet) , establishing some uniformity in each
lot's shape, all combined offer basis for consideration of a
request.
B) Other properties may or may not share in general the same
type of hardship should a similar proposal be made. It can
be said that this specific case has unusual characteristics in
that a majority of the current requirements can be met under
the proposal.
C) Whether or not the granting of this request will be of any
detriment to the adjacent property or that the districts
character will change is a decision that the Board of
Zoning Appeals will have to decide when they are presented
the case. The staff would add that the change in property
line occurs internally and does not effect the outer
boundary, specifically the road frontage.
