TAX MAP/PARCEL: 78/17A1 ZONING: C-1 (Commercial) LOCATION: Located on south side of St. Rt 250 east . 1 mile west of intersection of St. Rt. 20 The applicant requests relief from Section 4 . 15. 3 . 6 of the Albemarle County Zoning Ordinance, which states: "4 . 15. 3 PERMITTED SIGNS 4 . 15. 3 . 6 COMMERCIAL (C-1) AND COMMERICAL OFFICE (CO) Business Signs, Free-standing or Projecting: Provided: (a) if illuminated, no moving, flashing, blinding, color- changing or exposed, bare or uncovered neon illumination or lighting; (b) the aggregate area of such signs shall not exceed fifty (50) square feet; (c) no portion of such sign shall be greater than thirty (30) feet from ground level or the eave line of the roof of the main building located on the premises upon which such sign is erected, whichever is greater; (d) no more than two (2) free-standing signs on any one (1) lot or premises; (e) no more than three (3) projecting signs. " The applicant wishes to increase the fifty (50) square foot area of free-standing business signs to a maximum of seventy-two (72) square feet, a variance of twenty-two (22) feet. Zoning of the adjacent properties in respect to the applicant's are C-1 Commercial with the exception of the three (3) businesses located at the intersection of St. Rt. 20 and St. Rt. 250 east. The applicant already carries the non-conforming status in that the existing free-standing signage is in excess of the present allowable fifty (50) square foot aggregate area. It is the request of the applicant to increase the sign area to display or make known the three (3) sections of fuel grades offered at the site to the motoring public. The staff provides the following comments to the Board of Zoning Appeals for their consideration. A) It is not clearly demonstrated that an undue hardship exists. The square footage of the signs existing is already greater than the C-1 zone provision currently allowed. Majority of the adjacent properties are under the same zoning designation of C-1 commercial. Page 2 B) It could be said that the adjacent properties would generally share the same hardship, should they wish to increase their business signage, as requested by the applicant. Other types of signs are available to the applicant if the existing wall signage does not total more than one hundred (100) square foot aggregate area. (C) It has not been any basis established that demonstrates that a variance will not be of any detriment to the adjacent property or that the character of the district would not change. Should any detriment result, it may be felt mostly by the other adjacent properties with C-i zoning designation.
