Subject: SDP-2018-0091 (Oakleigh — Minor Site Plan Amendment)
The County of Albemarle Planning Division will recommend approval of the plan referenced
above once the following comments have been satisfactorily addressed (The following comments
are those that have been identified at this time. Additional comments or conditions may be added
or eliminated based on further review.): [Each comment is preceded by the applicable reference,
which is to the Subdivision/Zoning Ordinances unless otherwise specified.]
[ZMA2016-15 Proffer #31
a. Rev. 2: Comment not yet fully addressed. Comment response letter states
"Tree #31A is to remain." However, on sheet 3 there is still an "X" over Tree
#31A. Clarify and revise as necessary.
b. Address the following:
i. The detail provided on Sheet 7 does not match the preservation
methods specified in the Arborist's letter on 3/29/19 which was a
condition of the special exception that was approved on 7/3/19. Prior
to the Director of Planning's review of this change submit a letter from
the Arborist about the revision utilizing "permeable asphalt" in place of
"permeable pavers" and the other aspects of the section shown on
Sheet 7. Also, staff has a concern about the chemicals that are found
in permeable asphalt and whether those chemicals would be more
detrimental to the health of the preserved trees than permeable
"pavers".
[ZMA2016-15 Proffer #4] Rev. 2: A draft version of the Covenant and Restriction
document has been provided for review. This document includes a provision for public
pedestrian access (11.11) for all of Oakleigh. Since the C&R provides the required
pedestrian access specified in Proffer 4 the provision for the public pedestrian access must
be approved by the County and the C&R must be recorded prior to this minor site plan
amendment's approval, as required by Zoning and the County Attorney. In addition,
address the following comments from the County Attorney and Zoning within the C&R:
a. Revise section 11.11 of the C&R to state (changes highlighted):
11.11 Ingress/Egress; Public Pedestrian Access. The Declarant shall
establish an interconnecting system of roads and streets, so that each Lot will
at all times have a right of way that allows for direct vehicular and pedestrian
ingress/egress from a Lot to a publicly dedicated right of way. Further, this
Declaration hereby establishes and grants a public right of way for pedestrian
access over all sidewalks within the Property (as such sidewalks are shown
and identified on the approved site plan). This right shall be in perpetuity and
shall expressly benefit the County and the Board of Supervisors of the
County (the "Board"), who each are hereby third -party beneficiaries of this
public dedication of access easement. The County and Board shall have the
right and authority to enforce the provisions of such access easement for the
benefit of the public for ingress and egress over the sidewalks as provided in
this Declaration as though they were parties hereto. No public agency,
including the Virginia Department of Transportation and the County of
Albemarle, Virginia, will be responsible for maintaining any improvement
identified herein."
b. Revise section 11.12 of the C&R to include the deed book and page number
of the Cross -easement for parking.
3. [ZMA2016-15, 32.5.2(a) & 32.6.2(a)] Rev. 2: Revise the site plan, layout, labels and tables
to address the BOS's approval of Variation #1 (7/3/2019) of ZMA2016-15. Please note that
since building and parking setbacks were revised in other blocks those setback lines should
also be revised to adhere to the setbacks table approved in Variation #1.
4. [32.5.2(i) & 32.6.2(a)] Easements. Rev. 2: Address the following:
a. An easement plat has been submitted, reviewed and comments provided 7/5/2019.
The easements must be approved, recorded and proof of recordation provided to
the planning reviewer prior to the approval of the minor amendment.
b. Provide the deed book and page number for the realigned gas line easement. The
previously recorded gas line easement DB 4927 PG 170 appears to be in a different
location than what is shown on sheet 12.
5. [32.5.2(b) & 32.6.2(a)] Open Space. Please revise the label in the chart on Sheet 2 to be
as it was in the Major Amendment ("Pervious Area/Open Space") but ensure that the value
has been updated for the changes from both the previously approved minor amendment
and this minor amendment where there are no longer any open space areas platted in lot 4.
6. [32.5.2(b), 32.5.2(n), 32.6.1(e) & 32.6.2(a)]Rev. 2: Although the parking calculation table
shows that there is insufficient parking to meet the minimum requirements without special
agreements, if there are only 8 residential units in each of the Block 1 & 2 buildings as
stated in the chart, then there appears to be sufficient parking. Revise the parking
calculation tables as follows:
a. If there are only 8 residential units in each of the Block 1 & 2 buildings then each
building only requires 16 residential parking spaces. That would mean that there
would only be 71 (not 87) parking spaces required for each of those buildings.
b. The BOS approved on 7/3/19 the removal of wording from the Application plan that
specified 2 parking spaces for all units. Update the chart to specify 1.5 parking
spaces for each of the 1-Bedroom residential units in Block IV. This would reduce
the required parking in Block IV to 42 instead of 48.
c. Revise the Grand Total of required parking spaces. With the two changes above, if
there are only 8 residential units in each of the Block 1 & 2 buildings, that should
reduce the required parking spaces to 265 rather than 303.
7. [32.5.2(b) & 32.6.2(1)] Recreational Areas. Address the following:
a. It appears that there may be a fence on top of the retaining wall that is between the
tot lot and the parking in Block 1. However, the labels, leaders, and section/detail
information do not appear to be complete on Sheet 4. Ensure there is a detail for
the 2' railing specified on sheet 5 and that the "railing" is sufficient to stop children
from passing through it. Also, ensure all information about fencing of the tot lot on
the Block 1 side (linework, labels, leaders, detail labels) is shown on sheet 4.
b. The height of the wall between the tot lot and the memorial garden, on the side of
the tot lot, appears to vary greatly over its length. There appears to be sections
that are as low as 3" and as high as 3'. The shortest portion of the wall is adjacent
to Eckerson Court, and therefore would be no barrier to children straying into the
street. Ensure that any portion of the wall between the tot lot and the memorial
garden that is less than approximately 18" in height, on the tot lot side, has a fence
or railing on top of it to ensure that children do not go into the road or fall into the
memorial garden.
c. As mentioned above the height of the wall between the tot lot and the memorial
garden, on the side of the tot lot, appears to vary greatly over its length. There are
portions that appear to be too tall and too short for sitting. Provide information on
the portion of this retaining wall that would provide sufficient seat height (18") or
provide the two required benches as previously specified. Two benches would
provide 12' of seating area. Show that a total of at least 12' of seating area is
provided for the tot lot.
d. Provide the required swing with at least 4 seats.
e. Remove the words "(Optional)" in Section D/24 for the climber. Two climbers are
required and only one is provided on the detail that is included with the slide.
f. Provide the required Buckabout.
g. Address the comments above and then ensure all equipment and benches shown
on the site plan have manufacture details and pictures provided on sheet 24.
8. [32.5.2(n) & 32.6.2(a)] Walls. A wall height table has been provided. However, the labels
for the individual walls are no longer provided on the site plan and need to be so that the
labels specified in the wall height chart can be associated with the individual walls.
Address the following:
a. Provide labels on each of the walls that correspond to the labels shown in the chart.
b. Provide information to the plan reviewer on any of the wall heights, other than for
the dumpster screening wall, that is above 6' high. It appears that multiple walls are
8' in height, and depending on their location, may be visible from the Entrance
Corridor.
9. Provide accurate revision dates on the plans.
10. Rev. 2: Replace the directional arrows on the site plan that were previously approved and
removed any notes added in reference to the directional arrows being allowed to be
revised. A Letter of Revision (LOR) has been submitted requesting that the directional
arrows be removed from the site plan. This request will be reviewed within the LOR and
not this minor amendment. VDOT and engineering review of the requested change is
required.
11. Rev. 2: Only show revision clouds for those changes included for this minor amendment.
Staff apologizes for the wording of the previous comment that caused this misinterpretation.
12. Rev. 2: There have been "alternate" sections provided for both the permeable pavers and
the grass pavers. "alternative" materials/section/construction methods are not approvable.
Address the following:
a. Pick one material/section/construction method for each and remove the "alternate"
from the site plan.
b. Revise the labels that were "permeable pavers" and recently changed to
"permeable pavement" to be correct for the sections chosen.
c. Revise the heading under the "Permeable Pavers"/"Permeable Asphalt" on sheet 7
to not include the wording "Modified Per Arborist". Modifications must be approved
by the Director of Planning.
d. If "Permeable Interlocking Pavers" section remains in the site plan remove the note
within the detail on sheet 8 that states, "Pavement may be substituted to permeable
asphalt per approved WPO/VSMP plans. See detail this sheet K/8"
13. See the attached comments from the other reviewers.
Staff has provided references to provisions of Chapter 18 of the Code of the County of Albemarle. The
Code is kept up to date by the County Attorney's office. The Code may be found on the County
Attorney's website which may be found under "Departments" at Albemarle.org.
In accord with the provisions of Section 32.4.3.5 of Chapter 18 of the Code if the developer fails to
submit a revised final site plan to address all of the requirements within six (6) months after the date of
this letter the application shall be deemed to have been voluntarily withdrawn by the developer.
