This variance approval allows relief from Section 10 . 4 of the Albemarle County Zoning Ordinance to allow the reduction of the rear yard requirement of thirty-five (35) feet to seventeen (17) feet, to allow an addition to the firehouse. VA-89-30 Planning Department STAFF REPORT - VA-89-30 APPLICANT: Scottsville Volunteer Fire Department, Inc. TAX MAP/PARCEL: 130A(1)/64 ZONING: RA (Rural Areas) LOCATION: Located on the south side of St. Rt 6, + .25 miles west of the intersection of Rt 6 and Rt 726. The applicant seeks relief from Section 10.4 of the Albemarle County Zoning Ordinance, which states: "10.4 AREA AND BULK REGULATIONS Yards, minimum: Front 75 feet 75 feet Side 25 feet 25 feet Rear 35 feet 35 feet" The applicant seeks relief from the required thirty five (35) foot rear yard setback to locate a proposed bay addition to the existing fire station within seventeen (17) feet, a variance of eighteen (18) feet. The addition will have an upper level which will accommodate office and storage space. The existing fire department facility was allowed to locate within seventy- five (75) feet of the front property line or within the designated Scenic Overlay District (Rt 6) , by means of a variance VA-78-25 granted on June 13, 1978. Topography of the site is gentle with a gradual drop of approximately six (6) to eight (8) feet from the front of the property to the rear. About a six (6) foot to eight (8) foot elevation difference from the front to the rear of the property, exists. The rear corner of the existing structure is approximately thirty-seven (37) feet from the rear property line. The most practical location for a proposed addition to the present structure is being pursued. Screening is afforded along the perimeter of the adjacent properties. A two (2) story addition is proposed, providing a bay on the lower or ground area, and office-storage space on the upper level. The following comments are offered to the Board of Zoning Appeals in consideration of the requested application: A) There appears to be no special conditions that are peculiar to the land or building that are not applicable to other properties in the same zoning district. It should be shown that a strict application of the ordinance requirements would produce an undue hardship. Staff Report - VA-89-30 Page 2 B) It should be that the hardship involved is not shared by other properties in the same vicinity and/or zoning district. The applicant has already been given relief from the front setback, which has been reduced by half the required distance. C) Granting relief should not confer to the applicant any special privilege that is denied to other properties in the same zoning district. Any relief granted should be in harmony and in keeping with the spirit and purpose of the ordinance.
