Gentlemen:
I am hereby requesting a variance from the requirements
of the Albemarle Zoning Ordinance , specifically to reduce
the required setback distance from an existing right-of-way
to the edge of a dwelling unit from 75 feet to 50 feet . The
reasons for my request are as follows:
1 . The site where this dwelling unit is to be located
has one large mature Oak tree measuring seven feet in
circumference at its base which would be positioned
perilously close to the new construction as required by the
75-foot setback. The foundation wall of the dwelling unit
would be approximately 6 feet from the base of the tree ,
which would almost certainly destroy the root system of the
tree , which also happens to be the only tree in the vicinity
of the proposed dwelling unit . As a critical element of the
landscape this majestic oak hopefully can be maintained to
provide not only an esthetically pleasing environment , but
also potential energy savings to this dwelling unit by
providing substantial shade in summer as it is sited on the
southern exposure of the dwelling unit .
2 . Concerning the topography of the site , the required
setback would place the proposed structure on rather sloping
terrain. Moving the requested 25 feet would provide less
sloping terrain and would facilitate drainage around the
dwelling unit . I have attempted to show on the accompanying
sketch the lay of the land with the natural barrier of a
wooded low area separating the existing home site with the
new site. By reducing the setback, the new dwelling unit
would be placed in a more central location of the site ,
providing a more esthetically pleasing position.
3 . I would ask also that consideration be given the
broader perspective concerning the location of this site ,
being approximately 1200 feet from Route 637 and not visible
from any state or county road.
4 . By allowing a small reduction of the setback
distance required by the zoning ordinance , the placement of
this dwelling unit would reflect a more rational use of the
land, considering topographical and physical features and
the natural boundaries of the site . This would precisely
reflect the environmental standards set forth in the
Comprehensive Plan with regard to residential development .

variance from Section 10.4 (RA zoning district) of the Albemarle
County Zoning Ordinance to allow the reduction of front yard
