Dear Mr. Brady:
Thank you for meeting with Mrs. Butler and myself Monday morning, regarding the
setback requirements on her property. As contractor of record, Jim Walter Homes
Inc. submitted teh application and site plans necessary to obtain a building permit.
The permit to build a new single family dwelling on Parcel 30/Tax Map 92, was
issued in March of this year. A copy of that permit and the site plan we submitted
are attached.
The site plan references the 75 foot setback required for the front line on the
property; however, the foundation was not dug and poured according to that site
plan. As you are well aware, the county foundation inspector passed it, even
though it was closer to the road than the 75 foot minimum.
We appreciate the County sharing the responsibility for the error, especially
since the house was completed before the error was discovered. The Butler's are
now asking for a variance so that they will be able to obtain a C.O. and live in
their new home. There are, however, other reasons to consider for granting this
variance.
First of all, the topography of the lot includes a rather steep grade behind their
house. Also, soil studies done by the Sanitarian (Mr. Rice) were suitable only
for a two bedroom house and then only in a specific and restricted area of the
property. These conditions make it virtually impossible to reposition the house
at this point.
Obviously, we hope the variance will be approved. Please let me know if there is
any other information that you may need for the hearing on August 8th, 1989.
