Dear Ms. Patterson,
I am writing in regards to a request from Whiting Oil
Company, Inc. owners of property described as tax map 60, parcel
40D. We are the lessee of the adjoining parcel that is owned by
the H & H Partnership thus we feel we have an interest in the
matter.
We opened a branch bank on our site in November of 1987.
The visibility that our site has is already adversely affected by
the two( 2) adjoining owners which, we understand, made
improvements to their property before the advent of the current
zoning restrictions that apply.
It is our understanding that Whiting Oil is requesting a
variance to permit the construction of a canopy over their tanks.
It is our opinion that these improvements would further detract
from the poor visibility we presently must contend with and
further would detract from the appearance that the county is
attempting to create with their existing ordinances. Thus we
respectfully object to the application of Whiting Oil Company,
Inc.

Dear Ladies and Gentlemen:
This letter is to notify you, as adjoining property owners, that
Whiting Oil Company, Inc. (owner) , property described as tax map
60, parcel 40D, zoned HC, has made application for VA-89-66,
requesting relief from 30. 5. 6. 2 . 1•of the Albemarle County Zoning
Ordinance.
The applicant requests relief from Section 30.5. 6. 2 . 1 of the
Albemarle County Zoning Ordinance to reduce the required
front yard setback in the SA Overlay District from 150
feet to 10 feet to allow construction of a canopy, a
variance request of one hundred forty (140) feet.
A public hearing will be held by the Board of Zoning Appeals on
August 15, 1989 , at 3 : 15 p.m. , in Meeting Room #7 , Second Floor,
County Office Building, 401 McIntire Road, Charlottesville, VA.
This application is made available for your review in the
Albemarle County Zoning Office, 401 McIntire Road,
Charlottesville, VA.

Dear Ms. Patterson:
I am writing in regard to the application of Whiting Oil Company, Inc. , (owner
of the property described as Tax Map 60, Parcel 40D) , for relief from 30.5 .6.2.1
of the Albemarle County Zoning Ordinance.
The applicant justifies his request h; asserting that gasoline marketing
standards have changed so as to virtually doom his business to failure unless
relief from the ordinance is granted. His argument is appealing, but
unpersuasive. The law is absolutely clear that mere loss of profit opportunities
is not cause for relief, and the Board of Zoning Appeals has consistently so
held. Accordingly , T urge denial of the application.
Moreover, I am a general partner of H & H Partnership, owner of adjacent property
on which the F &. M Bank-Ivy Road Branch, is located. You may recall that we went
to some considerable expense to design a structure and site plan that would
conform to the character of the district. I might add that uur resulting
facility is less than optimal by branch banking facility marketing standards .
It is my opinion that the applicant 's construction of his proposed improvements
would further impair the visibility and value of our property. Consequently,
r respectfully urge denial of the application for relief.

Dear Ms. Patterson:
I am writing in regard to the application of Whiting Oil Company, Inc. , (owner
of the property described as Tax Map 60, Parcel 40D) , for relief from 30.5.6.2.1
of the Albemarle County Zoning Ordinance.
I am a general partner of Colonnade Associates Limited Partnership, owner of
adjacent property on which we are currently developing a retail shopping
facility. We have gone to great expense to develop our property with a
structure, land contours and landscaping that conform to the character of the
district.. It is my opinion that the applicant's construction of his proposed
canopy impairs the visibility, appeal and value of our property, and makes a
mockery of our attempts to conform our development to the character of the
district. Accordingly, I respectfully urge the Board to deny the applicant's
request for a setback variance.
