Dear Mr. & Mrs. Hutson:
' - This letter is to inform you that on August 15, 1989, during the
regular meeting of the Albemarle County Board of Zoning Appeals,
your application for VA-89-67 was approved.
This variance approval allows relief from Section 16. 3 of the
Albemarle County Zoning Ordinance to reduce the required side yard
setback from ten (10) feet to seven (7) feet to construct a room
addition, a variance request of three (3) feet.

Request:
The applicant seeks a variance from Section 16. 3 of the
Albemarle County Zoning Ordinance, which states:
"16. 3 Area and Bulk Regulations
Yards, minimum. . .
Side 15 feet . . .
(a) Minimum side yards shall be reduced to not less than
ten (10) feet in accordance with Section 4 . 11. 3 . "
The applicant proposes to construct a 11 foot by 24 foot room
addition on the east side of his existing home. A side setback
reduction from (10) feet to (7) feet is requested, a variance
of three (3) feet. The intended use is to enlarge the existing
living room and provide a dining room area. (See the attached
letter of justification)
Recommendation:
The area proposed for construction appears to be the most
practical area for this type of addition. There is a ten (10)
foot common area between this and the adjacent lot. Therefore,
this addition will actually be (17 . 5) feet from the neighbors
property line. There was another side yard variance approved
(VA-88-26) on Raven's Place, so it appears the authorization of a
variance will not alter the character of the yards in this
vicinity. However, the applicant does not satisfy the variance
criteria number one (1) and two (2) listed below.
Therefore the application should be denied for cause.
1. The applicant has not provided evidence that strict
application of the Zoning Ordinance would produce
a clearly demonstrable hardship approaching confiscation
as distinguished from a special privilege or convenience.
2 . The applicant has not demonstrated that the perceived
hardship is not shared by other properties in the same
zoning district and the same vicinity.
