The Site Review Committee has reviewed the development proposal referenced above. Initial comments

[General Comment] Per attached email, this application is being processed as a final subdivision plat under the
requirements of Section 14-206 of the Albemarle County Subdivision Ordinance.
a. The base cost of this application is $1,075 (final plat subdivision application fee) + $355.00 (Tier II
Groundwater Assessment Fee) + $215.00 (adjacent owner notification fee) _ $1,645.00 total. The
County has received payment for $936.00, which leaves a balance of $709.00 remaining. These fees
must be paid prior to County approval of the final plat.
2. [14-302 (B)(5)] Please revise note A on Sheet 1 so that it states that both TMPs "are zoned RA and are located
within the Airport Impact Area (AIA) Overlay District."
3. [14-302 (B)(1)] Please add a date of last revision.
4. [14-302 (B)(10)] Please add the line type used to represent the WPO stream buffer to the legend on Sheet 2.
5. [14-303 (D)] TMP 45-48 and 45-48D measure a combined 18.20 acres as specified in Note 4 on Sheet 1.
However, when adding the acreages of Lots A-E as noted in the labels on Sheet 2, the total acreage
amounts to 18.19 acres. Please explain where the missing 0.01 acres is located and revise the labels on
Sheet 2 if necessary.
6. [14-308.1] Tier II Groundwater Assessment has been initiated, results will be forwarded once complete.
7. [14-309, 14-310, 14-416] The soils evaluation reports were transmitted to the Virginia Department of
Health on July 2. The attached VDH comment letter is based on a review of the plat only, not a review of
the soil evaluation reports. VDH staff will issue another set of comments once the soils evaluations are
complete, and these will be forwarded to the applicant upon receipt.
[14-316] Comment is for reference and record keeping purposes only. Two (2) or more dwellings existed
on each parcel as of October 1, 2009 and one existing dwelling will be located on each new lot created by
this final plat. Requirements of Section 14-316 do not apply to any subdivision of a parcel where two (2)
or more dwellings existed on the parcel on October 14, 2009 and one existing dwelling would be located
on each lot created.
a. Additionally, VDOT has no objections to the new lots using the existing driveway entrance,
known as "Peach Way," to access the lots via Route 743. Please see attached letter from VDOT.
9. [14-317] Please submit an instrument evidencing maintenance of the proposed 30' and 50' private access
easements that provide access to Lots C and B from Lot D. The plat recorded in DB 4446 pages 333-346
included a maintenance agreement for the 30' private access easement along Peach Way. A template for the
private maintenance agreement is attached and may be completed and submitted with the next plat submittal for
review.
10. [14-400] Comment is for reference and record keeping purposes only. Pursuant to Section 14-400 of the
Subdivision Ordinance:
a. [14-403] All lots within this subdivision (Lots A-E) are exempt from the minimum street frontage
measurements specified in Section 18-10.4 of the Albemarle County Zoning Ordinance. Two (2) or
more dwellings existed on each parcel as of October 1, 2009 and one existing dwelling will be located
on each new lot created by this final plat.
b. [14-404 (C)] All lots within this subdivision (Lots A-E) are exempt from the lot location and single point
of access requirements specified in Section 14-404 (A) and 14-404 (B) of the Subdivision Ordinance.
Two (2) or more dwellings existed on each parcel as of October 1, 2009 and one existing dwelling will
be located on each new lot created by this final plat.

Mr. Langille:
As requested, I've reviewed the subject Site Plan, dated May 15, 2019. The plan states
that public water and sewer services will not be available to these parcels.
All existing septic systems and reserve drainfield areas must be located on the plat. If
any of the proposed lots do not have reserve drainfield areas, I strongly recommend that
Community Development require that reserve drainfield areas be identified, and
approved by the Charlottesville / Albemarle Health Department, prior to approval of the
plat.
It appears that all five existing residences are being served by a single well on Lot B. If
this is the case, I recommend that easements be provided for the well and subsequent
waterlines for the four remaining proposed lots.

Some good news. Cameron discovered that the ordinance was amended in such a way to negate the condition about
the two houses accessing Naked Creek Run. No request for relief from the 1984 plat is needed.

It was nice having a weekend without rain or 100 degrees. Hope you got to enjoy the weekend.
The total fee is $1,075 of which $581 has already been submitted. This leaves a balance of $494. (The groundwater fee
is the same for all types of applications and has been submitted.) A total of 16 plats are needed for review. There are 4
in the file that I have.
You will need to submit a request for relief from the 1984 Planning Commission condition that the two existing houses
access Naked Creek Run. I have attached the signed 1984 plat for your use. This condition was imposed in accord with
Section 18-36F in 1984 that section has been amended and is now 14-404.
I hope this helps. Let me know what your client wants to do.

PRIVATE IMPROVEMENT MAINTENANCE DECLARATION
This PRIVATE IMPROVEMENT MAINTENANCE DECLARATION
(hereinafter, the "Declaration") is made this DAY of MONTH, YEAR, by OWNER1 and
OWNER2 (hereinafter, the "Declarant(s)"), whose address is ADDRESS.
WHEREAS, the Declarant(s) is/are the owner(s) of a parcel of land known as
Albemarle County Parcel ID PARCEL #; and
WHEREAS, Albemarle County Parcel ID PARCEL # is being subdivided by the
Declarant(s) into Lots # , as shown and described on a plat by SURVEYOR
NAME, dated DATE, a copy of which is attached hereto and incorporated herein by
reference (hereinafter, the "Plat"); and
WHEREAS, the access easement shown on the Plat is to be a new or existing # of
FEET WIDE foot wide non-exclusive ingress and egress easement (hereinafter, the
"Street") for the use and benefit of Lots # (or all lots) shown on the Plat.
NOW, THEREFORE, for and in consideration of the premises and the undertakings
contained herein, the Declarant(s) hereby impose(s) the following obligations upon Lots #
MINIMUM STANDARD: The Street shall be maintained in perpetuity to a standard
that, at a minimum, ensures that it will remain in substantially the same condition it
was in when approved by the County: (describe the standard that the street will be
constructed to. Example — a "X feet" wide base of gravel or a superior surface as
agreed to in the future via supplemental declaration). The travelway shall at all
times be maintained so that it is safe and convenient for passenger automobiles and
emergency vehicles at all times except in severe temporary weather conditions.
2. DEFINITIONS: For purposes of this instrument, "maintenance" includes the
maintenance of the private streets or alleys, and all curbs, curbs and gutters, drainage
facilities, utilities, dams, bridges and other private street improvements, and the prompt
removal of snow, water, debris, or any other obstruction so as to keep the private street
or alley reasonably open for usage by all vehicles, including emergency services
vehicles. The term "to maintain," or any derivation of that verb, includes the
maintenance, replacement, reconstruction and correction of defects or damage.
3. WHEN TO MAINTAIN: After the initial construction of the Street, any further
construction, maintenance or repair shall be undertaken only with the mutual consent
of all owners, provided that in the event that (a) one or more of the owners determines
that the Street is not safe and convenient for passenger automobiles and emergency
vehicles at all times (except in severe temporary weather conditions), and (b) such
owner(s) give(s) 30 days prior written notice to all other owners using the Street, such
owner(s) may commence or contract to bring the Street to the minimum standard, and
the resulting costs shall be the responsibility of all owners using the Street.
4. DEFAULTING OWNER(S): If any owner(s) fail(s) to pay their proportionate share
of the costs of maintenance or repair for which they are responsible, as provided
hereinabove, any other owner(s) not in default or the person or corporation performing
such maintenance may, after 30 days written notice to the defaulting parcel owner(s),
bring an action of law against each defaulting parcel owner(s) in a court of competent
jurisdiction and/or may record in the Clerk's Office of the Circuit Court of Albemarle
County, a Notice of Lien to secure the payment of any defaulting parcel owner(s)'
proportional share of maintenance or repair. The amount due by any delinquent
owner(s) will bear interest at the maximum judgment rate provided by law from the
date of completion of the maintenance. The delinquent owner(s) shall be liable for all
costs of collection, including reasonable attorney's fees.
5. COST OF MAINTENANCE: The owner(s) of Lots # shall be equally
responsible for the cost of the maintenance of and/or repair to the Street, from
LOCATION X to LOCATION Y. Any further division of Lots # shall
require the reassessment of cost to be equally shared by all owners using the Street.
6. No public agency, including the Virginia Department of Transportation and the
County of Albemarle, Virginia, will be responsible for maintaining any
improvement identified herein.
IN WITNESS WHEREOF, the Declarant(s) has/have caused this Declaration to be
executed on his/her/its/their behalf by his/her/its/their duly authorized agent.
