This variance approval allows relief from Section 10. 4 of the Albemarle County Zoning Ordinance to reduce the required front yard setback from seventy-five (75) feet to twenty-four (24) feet to construct a portico addition, a variance request of fifty-one (51) feet. VA-89-70 STAFF REPORT - VA-89-70 OWNER/APPLICANT: New Green Mountain Baptist Church TAX MAP/PARCEL: 128A1/26 ZONING: RA, Rural Areas ACREAGE: 1. 192 acres LOCATION: On the east side of Rt. 627, approximately 0. 3 to 0.5 mile north of Rt. 6 REQUEST: The applicant seeks a variance from Section 10.4 of the Albemarle County Zoning Ordinance. This section states: "Minimum Yard Requirements Yards, minimum . . . Front 75 feet . . . " The applicant proposes to construct a 9 foot X 26 foot 4 inch portico addition to the front of the church above the existing stoop. This will serve as protection during inclement weather. The portico which will extend 4 inches beyond the existing stoop, will be located twenty-four feet from the front property line, a variance request of fifty-one (51) feet. RECOMMENDATION: The Church submitted a building permit application for primarily renovation work. The narthex, or front hall before the sanctuary, is limited in capacity. Providing a cover above the steps is both a convenience and a type of safety improvement. The existing church does not meet the front yard setback. The subject parcel is triangular in shape, differing from those in the immediate vicinity. Due to the present location of the building on the property and the narthex within the building, no suitable alternative locations exist for the front portico. The applicant's request should be approved for cause: 1. The strict application of this Ordinance would produce undue hardship and would prohibit a minor safety improvement; 2 . The shape of this property and existing conditions are unique and not generally shared by other properties in the same zoning district and vicinity; 3 . The additional encroachment into the front yard setback is minimal. The authorization of such variance will not be of substantial detriment to adjacent properties nor will it change the character of the district.
