The Board ruled that the setback be granted to leave the sign in its current location, but denied the request to increase the size of the sign. This variance approval allows relief from Section 30.5. 2 .2 of the Albemarle County Zoning Ordinance to reduce the required front yard setback from 150 feet to 8 feet, a variance of 142 feet for the location of the identification sign. Patterson Zoning Administrator AMP/st cc: VA-89-75 S-89-84 Staff Person: John Grady Public Hearing: September 19, 1989 STAFF REPORT - VA 89-75 OWNER/APPLICANT: Richard & Louise Fisco (Owner) , Nancy Schneider (Applicant) TAX MAP/PARCEL: 77E1, Parcel 01-1 ZONING: Residential R-4 ACREAGE: 4 . 612 LOCATION: Located on Route 20 South, 1/10 of a mile south of the Route 20 and Route 53 intersection on the west side in front of Willow Lake Subdivision. REQUEST: The applicant requests relief from Sections 4 . 15. 3 . 3 and 30.5. 2 . 2 of the Albemarle County Zoning Ordinance, which states: "Section 4 . 15. 3 . 3 Area of identification sign not more than two (2) square feet. Section 30. 5.2 . 2 Setback of the Scenic Areas Highway Overlay District one hundred and fifty (150) feet. " Applicant requests to increase the area of an identification sign from two (2) square feet to nine (9) square feet, a seven (7) square foot variance. Applicant also requests to reduce the one hundred and fifty (150) foot setback for the scenic highway overlay district to eight (8) feet, a variance of one hundred forty-two (142) feet. RELEVANT HISTORY: Staff recognizes that each variance is reviewed on its own merits, and is not on its face, precedent-setting. The following history is provided for information: There is presently an identification sign on the property of approximately two (2) square feet identifying the Willow Lake Manor House. The applicant is currently pursuing an application for accessory tourist lodging at the site which is allowed by right in the Zoning Ordinance with approval from the Fire Marshall. Mrs. Schneider feels that a larger sign would vastly aid those who have made reservations with them in finding the Inn. The physical make-up of the sign, such as color and material has been approved 'by Mr. Wayne Cilimberg (Director of Planning) as required by Section 30.5. 7 . 1 of the Albemarle County Zoning Ordinance. Staff recognizes that the sign is not obtrusive in its physical make-up and the applicant does seem to need some relief for recognition. It is also apparent that authorization of such variance will not be of substantial detriment to adjacent property and that the character of the district will not be altered by the granting of the variance. STAFF REPORT - VA 89-75 PAGE TWO RECOMMENDATION However, it is staff's opinion that the applicant does not satisfy the criteria listed below, thus the application should be denied for cause. 1. The applicant has not provided evidence that the strict application of the ordinance would produce undue hardship; 2 . The applicant has not provided evidence that such hardship is not shared generally by other properties in the same zoning district and the same vicinity.
