Dear Mr. Grady,
At the request of Mr. Paul Beyer, I am submitting a short outline of my thoughts in
regard to the upcoming re-hearing of Mr. Jimmy Walker's application for a zoning
variance.
Currently, the deck is built to the property line. There is a space approximately
ten feet between the deck and a fence which belongs to Mr. Walker's neighbor. This
fence rests well within the neighbor's property.
The issue of whether or not to grant Mr. Walker a variance should, in my opinion
depend on whether or not the purpose of a setback is maintained. My understanding
of the most important purpose of a setback is that it should provide for "light and
air" between the properties, primarily an aesthetic consideration reflecting certain
community standards in regard to density.
Mr. Walker maintains that if the variance is denied, he will build a retaining wall
with a privacy fence; backfill it, and deck it with wood decking. The utility for
Mr. Walker will remain the same. The difference rests on a definition by the
building department of what constitutes a "structure." Obviously, the building
department cannot be expected to create an all-inclusive definition that provides
for every possible contingency, so therefore we have a situation where two
essentially similar structures fall on opposite sides of the semantic fence.
Holding fast to a literal interpretation of the code may preserve its sanctity.
But denying this request for a variance will not serve the purpose of a setback.
In either case, a structure will be in that same location. In fact, a retaining
wall/fence monolith would, in my opinion, eliminate any notion of light and air,
especially in relation to the existing structure, which is a deck "floating" over a
post-and-beam structure.
