Dear Ladies and Gentlemen:
This letter is to notify you, as adjoining property owners, that
Margaret Kay Steigman, property described as Tax Map 61W2, Parcel O1-P4,
Zoned R-10, has made application for VA-89-87, requesting relief from
Section 4.11.2.1 of the Albemarle County Zoning Ordinance, as follows:
The applicant seeks a variance from Section 4. 11.2.1 of the
Albemarle County Zoning Ordinance to reduce the setback of an
accessory structure from the minimum required measurement of
six (6) feet to zero (0) feet to allow construction of a deck.
A public hearing will be held by the Board of Zoning Appeals on
October 17, 1989, at 3:00 p.m. , in Meeting Room #7, Second Floor,
County Office Building, 401 McIntire Road, Charlottesville, Virginia.
This application is made available for your review in the Albemarle
County Zoning Office, 401 McIntire Road, Charlottesville, Virginia.

PETITION
TO THE ALBEMARLE COUNTY BOARD OF
ZONING APPEALS
RE: Variance Application VA-89-22
Tax Map 61W2-01, Parcel P-4
120 Blithe Court, Birnam Wood Subdivision
Kay P. Steigman
We, the undersigned owners of adjoining units in Block P, Section Two,
Birnam Wood, do hereby support the above-referenced variance application of Kay
P. Steigman, and we request that Ms. Steigman be permitted to maintain the deck
behind her unit (Lot 4, Block P, Section Two) in its present state, without the
forced removal or alteration which would be caused by a denial of her
application.
We strongly believe that to require Ms. Steigman to alter or remove her
existing deck will cause senseless and unnecessary disruption and potential
damage to all of our adjoining units, for the following reasons:
1. The deck serves an important function in stabilizing the steep bank
at the rear of all our units. There is a prior history of flooding, bank erosion
and water damage along this block, but no such problems have occurred since deck
structures were built beginning four years ago. To alter the structure now would
invite a possible recurrence of storm-water runoff flooding and erosion problems.
2. This area is well-settled and attractively landscaped. To force a
removal or alteration of the deck structure at this time would be terribly
disruptive to our neighborhood, and would create noise, dirt, soil disturbance,
construction traffic and landscape destruction, with absolutely no benefit to
anyone.
3. The deck in its present condition is very attractive, and enhances the
enjoyment and value of all the properties in the neighborhood.
For the above reasons, we strongly urge the Board of Zoning Appeals to grant
Variance application VA-89-22.
