This variance approval allows relief from Section 16. 3 of the Albemarle County Zoning Ordinance to reduce the rear yard setback requirement from 20 feet to 13 feet to allow construction of an addition, a variance of 7 feet. Fernandez TAX MAP/PARCEL: 61W2-02-OF-1 ZONING: R-6 ACREAGE: Approximately 3 , 100 square foot lot LOCATION: 1488 Minor Ridge Court in Minor Ridge Subdivision REQUEST: The applicant requests relief from Section 16. 3 of the Albemarle County Zoning Ordinance, which states: " Area and Bulk Regulations: Yards minimum: Rear 20 feet" The applicant is requesting a variance of 7 feet to allow construction of an addition to be located 13 feet from the rear property line. The addition will consist of a glass sunroom and storage area. RELEVANT HISTORY: Staff recognizes that each variance is reviewed on its own merits, and is not on its face, precedent-setting. The following history is provided for information: The following variances have been granted in the Minor Ridge Subdivision: 1. VA-84-80 A 5 foot variance to allow a storage shed to be 1 foot from the side property line. 2 . VA-85-29 A 4 foot variance to allow a storage shed to be 2 feet from the rear property line. 3 . VA-85-30 A 6 foot variance to allow a storage shed to be 0 feet from the side property line. 4 . VA-85-31 A 3 foot variance to allow a storage shed to be 3 feet from the side property line. 5. VA-85-32 A 6 foot variance to allow a storage shed to be 0 feet from the rear and side property lines. 6. VA-88-22 A 5 foot variance to allow a storage shed to be 1 foot from the side property line. Page 2 Staff Report - VA-89-90 RECOMMENDATION: Given the history of the previous variances for storage sheds in this area, staff does not feel that this request will be of substantial detriment nor will the character of the area be changed. Staff is also considerate of Mrs. Fernandez' allergic condition. However, staff does not feel that the applicant meets the criteria of the two criteria listed below. Staff recommends denial for cause: 1. The applicant has not provided evidence that the strict application of the ordinance would produce undue hardship; 2 . The applicant has not provided evidence that such hardship is not shared generally by other properties in the same zoning district and the same vicinity.
