STAFF REPORT - VA-89-93
APPLICANT: Bethel Baptist Church
TAX MAP/PARCEL: 89/5A
ACREAGE: 2 . 5 acres
ZONING: RA, Rural Areas with SP-89-67 for church
LOCATION: On the west side of Route 745, approximately
1 mile south of the intersection with Route 29
REQUEST:
The applicant requests a variance from Section 10.4 of the
Albemarle County Zoning Ordinance. This section states:
"10.4 AREA AND BULK REGULATIONS
Yards, minimum:
Front 75 feet . . . "
The applicant requests a front setback of 20 feet, a variance of
55 feet. They propose construction of a fellowship hall of 24
feet X 32 feet. The church expansion was recently approved by
SP-89-67 . Presently, they must move church pews for meetings and
socials.
The building addition will not be closer to the property line, but
will be setback 3 feet further than the existing structure. Any
building addition would necessitate a setback variance. Building
expansion to the rear is constrained by the location of the
cemetery, steep slopes, and the access road.
RECOMMENDATION:
The proposed addition would, in the opinion of the Director of
Inspections, present improved fire safety than the present
arrangement using the sanctuary.
It is staff's opinion, that the applicant does possess undue
hardship that is not shared generally, and is not of substantial
detriment. The access road is necessary to provide access around
the building and access to the cemetery and second entrance.
There is approximately 10 feet from the rear of the building to a
steep hill (critical slope) on which gravesites are located. The
proposed addition would not substantially impact the district, by
not encroaching further than the present structure. No other
structures on adjacent property are in close proximity.

Staff recommends approval for cause:
1. The applicant has provided evidence that the strict
application of the ordinance would produce undue hardship.
2 . The applicant has provided evidence that such hardship is
not shared generally by other properties in the same zoning
district and the same vicinity;
3 . The applicant has provided evidence that the authorization
of such variance will not be of substantial detriment to
adjacent property and that the character of the district
will not be changed by the granting of the variance.
