Edwards AFE/mb The subject property was acquired by Herndon House Properties ( hereinafter Herndon ) in 1988 . The property is improved by a structure containing 11 ,000 square feet . Herndon purchased the property for the purpose of operating a retail furniture store; the property has never been used for any other purpose and is currently occupied by Herndon House , Incorporated . When Herndon acquired the property the site plan was approved and was in compliance with the ordinance , then in effect , which established the number of parking spaces required for the business . This property is part of the Riverbend Shopping Center , a Planned Development-Shopping Center . Herndon House , Incorporated has suffered business losses , finds that is cannot operate profitably and will close within the next three months . Herndon is offering the property for sale but believes that it is unlikely that a potential purchaser would choose to operate a furniture store in the same location where a similar business had recently been unsuccessful . The property was acquired by Herndon in good faith and for its stated purpose . Since the approval of Herndon 's Site Plan , the ordinance scheduling required parking has been changed . Because this property is part of the PD-SCDO , the ordinance now requires 5-1/2 parking spaces per 1000 square feet . The subject property has twenty ( 20 ) parking spaces . Herndon requested that B . Aubrey Huffman & Associates , Ltd . ( Huffman ) , civil engineers , examine the property to see if additional spaces might be obtained . Huffman believes that the property is not suitable for placement of additional spaces; nor would placement of the spaces be economically feasible . Certainly the addition of even a small number of spaces would require an easement from the adjacent property owner and the sacrifice of green space which is part of the approved Site Plan . The topography of this property and the surrounding property makes a portion of the land unusable for the purpose of creating additional parking . Strict application and enforcement of the ordinance would unreasonably restrict the use of the property . Without the granting of a variance , it is unlikely that a buyer will easily be found and the furniture store currently occupying the building will not be in operation after January of 1990 . It would not enhance the future development of the shopping center to have a prominent building stand unoccupied for a long period of time . As previously noted , the property is part of a PD-SCDO . As such there is close parking available generally in the area . Some parcels closely located provide a greater number of spaces than would be required by ordinance . Granting this request for a variance would not have a negative impact on surrounding businesses . Though the adjacent properties do not have cross easements for parking , the Declaration of Reciprocal Easements and Maintenance Agreement between Herndon and Riverbend Limited Partnership does contain cross-easements for ingress and egress and speaks of the intent that free movement of pedestrians and motor vehicles be available for owners , tenants , and customers served by these properties . Granting a variance to Herndon for this property will alleviate a hardship without violating the spirit of the ordinance .
