OF ZONING BOARD OF ZONING APPEALS CH ARLOTTESV I LLE. VA. Dear Board Members: My name is Glenn Robertson and I come before the board as president of Smith & Robertson Inc.. a Virginia State registered building contractor that has made a most unfortunate and embarrassing error. Over the years I have appeared before this hoard on several occasions requesting setback variances for my construction clients. On this occasion however I must request a setback variance 2I-2 er construction has progressed to a point of no return. Please accept my sincere apology for this unprofessional approach. Enclosed is a plat of the subject property, Lot 5. Mechums West Subdivision, owned by Daniel Becker and Madaiine Harrison. As you can see. the northeast corner of the residence encroaches on the from setback by 2 1 i 2 feet. Our error occurred because we used the center of the road to create our setback line for siting the house. We incorrectly assumed that the road was in the center of its 50 easement and pulled the tape from the center of the road. added the 60 front setback and flagged the site. The lot is thin and the only house site was as close to the setback as possible. We set the corner 3 back. from our setback flags and began construction_ RT.1 • BOX 131 • BARBOURSVILLE, VA. 22923 • (804) 973-7026 This error in iudgement was so small that even the County Building Inspector missed the encroachment during his footing inspection. _onstruction was well under way and framing was nearly complete before the survey indicated our error. Apparently the road meanders within its 50 easement and we should have had a surveyor accurately stake the setback line. Upon discovery- of our mistake, the project had reached a point where contracts with subcontractors and the Property wwriers seemed to prevail. We felt ‘ve had no real chc,ice but to pruce,,,d and be for the board 'z understanding and mercy. As a Class 'A- building contractor operating in Albemarle County for H Years this is the first time a situation like this has arisen, it is a most embarrassing and unprofessional mistake and I can assure the board that it will not happen again. I have learned a costly lesson and ; pray that the board will grant my request for the 3 front setback variance. Thank You. Sincerely.
