Safley Rt. 7, Box 207 Charlottesville, Virginia 22901 We (R.E. and Faye Safley) started making plans to build a storage shed on our property facing North 20, Stony Point Road. To comply with county ordinance, we carried a copy of our plat to the Inspections Department, from there we were sent to the Zoning Department, where we had a long discussion with Mr. John Grady and Mr. Tom Eaton. We informed Mr. Grady of our interest in building a storage shed on our porperty. We emphasized in our conversation with Mr. Grady and Mr. Eaton, that it was very important to us if we could not build in the selected area, we absolutely did not want to invest into a builder's permit. Our main goal there was to see if we could build. We went over the plat map with Mr. Grady, showed him the exact location on the, map. We discussed the layout of the property, and pointed out the building site would sit in front of the property facing . North 20. Based on our conversation with Mr. Grady and the fact that he knew the area we left the Zoning Department feeling very confident that there would not be a problem in building. Plans were made for Mr. Eaton and Mr. Safley to meet on site and the stakes were set. However, when the stakes were set, one was set facing North 20 and one facing our secondary road, but none was put on the lower corner of the property. We still had doubt in our mind, so we went back to the Zoning Department. At that point we were informed that we could start our project as long as we stayed within the stakes. Instead of a solid foundation we had decided to used piers so on November 3, 1989 we went to the Inspection Department and Dwayne Via helped us to revise our drawings. Again, we asked if the Builder's Permit had been issued and it had on October 23, 1989 and we were told we could proceed. Mr. Safley had the grading done and a week later the footings were prepared and ready for the inspection. A new measurement was done and the lower corner turned out to be 77 feet instead of 90 feet required by the county regulations from the center of North 20. We were not aware of this requirement. We were told on November 14, 1989 that our job site had been rejected because of this difference and that a senior inspector should have been on the site in the beginning. We were trying to meet all regulations and rules by coming to the county office three times. We would not have started the expense of grading and footings if we thought there was going to be a problem. We were given only positive input. When we received the approved building permit and were told to proceed we thought we were within all regulations. We would like to ask for approximately 13 feet variance so we can build our shed. The elevation of our property in the front and rear will not permit us to change our building site. This was all taken into consideration when we went to the Zoning Department for their evaluation and advice. • • There were comments that the site was in a flood area and that has been corrected by the State Highway Department. At the present we have a builder's permit investment, plus $507.00 in supplies and we are asking if the Zoning Department can grant us this variance so we may finish our project and we won't lose our money. If the variance is not approved we will lose even more money because we will have to spend $250.00 more to shape the property to the original design.
