This letter is to inform you that on October 17 , 1989, deurs our
the meeting of the Albemarle County Board of Zoning App , Y
application for VA-89-80 was approved to allow an identification
sign to be ten (10) square feet in size and to be located ten (10)
feet from the right-of-way.
This variance approval allows relief from Sections 4 . 15.3 .2
and 13 . 3 of the Albemarle County Zoning Ordinance.
Anyone aggrieved by a decision of the Board can appeal the
decision to the Circuit Court of Albemarle County within thirty
(30) days of the decision.

Dear Pastor Hudson:
The variance you have received for the signage on your site will
allow a sign ten (10) square feet. The sign face with the message
measures ten (10) square feet. The cross on the stone pillar will
also be considered part of the sign. This addition will add square
footage to the sign area. This increase in the area of the sign
does not conform to the approved variance.
However, the Albemarle County Board of Supervisors will blbe
reviewing changes to the existing sign ordinance in a p
hearing on July 8 , 1992 . The changes include an increase in the
area allowed within the R-1 zone. You will find enclosed a draft
of the portion of the ordinance pertaining to the R-1 zone The
proposed change to this zone will allow a twenty-four (24) square
foot sign, ten (10) feet in height. Your construction s drawings
indicate that you could build the low sign, pillar
message area. Once the proposed ordinance is adopted, the cross
could be installed at a later date. Your other alternative is to
request a variance for the size of the sign to include the addition
of the cross.

schedule for filing a variance application. The next date for

REQUEST:
The applicant requests relief from Sections 4 . 15. 3 .2 and 13 . 3
of the Albemarle County Zoning Ordinance. These sections state:
"4 . 15. 3 .2 Village Residential (VR) and Residential (R-1)
Identification Signs: Provided: (a) not more than two (2)
square feet in area; and (b) not more than one (1) on any
lot or premises. "

Yards, minimum: front 25 feet . . .
The applicant proposes to install a 30 square foot identification
sign to be located 1 foot from the front property line. The sign
will be internally illuminated with a fiberglass message board
and aluminum frame. The skirting of the sign will be brick.
RELEVANT HISTORY:
Staff recognizes that each variance is reviewed on its own merits,
and is not on its face, precedent-setting. The following history
is provided for information:
On December 14 , 1982 , the Board of Zoning Appeals approved a
variance (VA-82-63) to allow a sign for J.V. Farm Equipment
(adjacent to the south of this property) to be 10 feet from the
right-of-way.
RECOMMENDATION:
From the turn lane of Route 742 to the front of the church there
is an increase in elevation of approximately 16 feet. At that
point the property starts to decline in elevation, prohibiting
full visibility of the church building. To the north of the
property on an adjacent parcel of land there is a tree line which
decreases the visibility of the church. Coming from the north,
you do not see the church until you are at the entrance. To the
south, there is adjacent landscaping which also affects the
church's visibility. The proposed sign would be more visible than
the church building coming from either direction. The church

Staff recognizes that the authorization of the variance will
not be of substantial detriment to adjacent properties and that
the character of the district will not be altered. The applicant
has demonstrated that because of the topography of the property
and adjacent landscaping, the perceived hardship is unique to
this property in contradistinction to other properties in the
same zoning district.
Staff recommends that the application be denied for cause:
(1) The applicant has not provided sufficient evidence to
show that a strict application of the Zoning Ordinance
would produce a clearly demonstrable hardship approaching
confiscation as distinguished from a special privilege
or convenience.
