This letter is to inform you that on March 13, 1990, during the meeting of the
Albemarle County Board of Zoning Appeals, the Board unanimously approved your
request for VA-90-14.
This approval allows identification sign as follows:
(1) 10' from right-of-way
(2) 4 square feet maximuim
(3) No phone numbers to be on sign
(4) Removal of name on posts at entrance
(5) Approval is for applicant only

ACREAGE: 8 . 285 acres
LOCATION: On Route 20 south, approximately 1. 5 miles
south of the Route 20 and Route 742
intersection on the east side of Route 20
REQUEST:
The applicant requests relief from Section 4 . 15. 3 . 1 and 30. 5.2 . 2
of the Albemarle County Zoning Ordinance, which states:
"4. 15. 3 . 1 AREA OF IDENTIFICATION SIGN
Not more than four (4) square feet. "

OVERLAY DISTRICT
one hundred fifty (150) feet. "
Applicant requests to increase the area of an identification sign
from 4 square feet to 5.75 square feet, a variance of 1. 5 square
feet. Applicant also requests to reduce the 150 foot setback for
the scenic highway overlay district to 1 foot, a variance of 149
feet.
The applicant's justification includes:
1. To help identify the site, as the applicant provides a child
care service.
2 . The sign located at 150 feet would not be legible and serve
no purpose to our parents.
3 . The vegetation and topography of the site would also render
the sign useless at 150 feet.
RELEVANT HISTORY:
Staff recognizes that each variance is reviewed on its own merits,
and is not on its face, precedent-setting. The following history
is provided for information:
On September 21, 1989 variance 89-75 for Nancy Schneider, (The Inn
at Monticello) , was granted relief to reduce the 150 foot setback
to 8 feet from the right-of-way for an identification sign, but
was denied the variance section to increase the square footage or
area of such sign.

RECOMMENDATION:
Staff agrees that there is a topographic hardship, because there
is a rise in elevation from Route 20 as you enter the Jamerson's
property for about 50 feet. Then there is a decline in elevation
for approximately 100 feet. However, it is staff's opinion that
the applicant does not satisfy the criteria listed below, thus the
application should be denied for cause.
Staff recommends denial for cause:
1. The applicant has not provided evidence that the strict
application of the ordinance would produce undue hardship.
2 . The applicant has not provided evidence that the authorization
of such variance will not be of substantial detriment to
adjacent property and that the character of the district
will not be changed by the granting of the variance.
Should the Board of Zoning Appeals find cause to approve this
variance, staff recommends the following conditions.
1. That variance approval be for current applicant only.
2 . That sign must meet the required aggregate area of four (4)
square feet.
