Box 5548 Charlottesville, VA 22905 RE: Board of Zoning Appeals Action VA-90-18, Tax Map 45B(1), Parcel 1B Dear Mr. Wood: This letter is to inform you that on April 10, 1990, during the meeting of the Albemarle County Board of Zoning Appeals, the Board unanimously approved your request for VA-90-18, subject to the following conditions: (1) Wall signs to be measured by 1.5 square feet to 1 linear foot of business frontage. (2) Only 1 wall sign per tenant. (3) No wall sign shall exceed a 200 square foot total. (4) No roof signs shall be erected on this site. (5) Site shall be limited to one (1) freestanding (pedestal) sign not to exceed 50 square feet and shall identify the site only. No free- standing menu board sign shall be used. This variance approval allows relief from Section 4.15.3.7 of the Albemarle County Zoning Ordinance to increase the total square footage for wall signs from 200 square feet to 1150 square feet, a variance of 950 square feet, and from Section 21.7. 1 to reduce the front yard setback from 30 feet to 10 feet, a variance of 20 feet for the placement of a freestanding sign. Wood TAX MAP/PARCEL: 45B(1)/1B ACREAGE: Approximately 10 acres ZONING: HC, Highway Commercial LOCATION: On the east side of Route 29 north approximately 1 mile north of the intersection of Route 29 north and Rio Road REQUEST: The applicant requests relief from Sections 4 . 15. 3 . 7 and 21. 7 . 1 of the Albemarle County Zoning Ordinance. This section states: "4 . 15. 3 .7 HIGHWAY COMMERCIAL (HC) ; PLANNED DEVELOPMENT SHOPPING CENTER (PD-SC) ; and PLANNED DEVELOPMENT-MIXED COMMERCIAL (PD-MC) . . . Business Sign, Wall: Provided: . . . (b) the aggregate area of all such signs shall not exceed two hundred (200) square feet; . . . " "21.7 MINIMUM YARD REQUIREMENTS 21.7 . 1 Adjacent to public streets: No portion of any structure except signs advertising sale or rental of the property shall be erected closer than thirty (30) feet to any public street right-of-way. " The applicant requests a variance from Section 4 . 15. 3 . 7 of the Albemarle County Zoning Ordinance to increase the total square footage for wall signs from 200 square feet to 1150 square feet,a variance of 950 square feet. Applicant also requests a variance from Section 21. 7 . 1 of the Albemarle County Zoning Ordinance to reduce the front yard setback from 30 feet to 10 feet, a variance of 20 feet for the placement of a freestanding sign. The applicant's justification for variance includes the following: 1. Style and appearance of the site reflects the image of a shopping center rather than the use of a single business tenant. Upon completion of all phases the site will be occupied by multiple tenants, approximately 30 or more and 200 square feet will not adequately identify each respective business. 3 . Due to the location of the buildings and the speed of the traffic approximately 55 miles an hour the signage allowed per tenant (approximately 3 square feet) would be ineffective. 4 . The 50 square foot freestanding sign is half the 100 square feet that is currently allowed in the Highway Commercial zone. RECOMMENDATION: The applicant's request does meet the criteria that the Zoning Department will be presenting at a later date this year to change certain sections of the sign ordinance. Therefore, staff would recommend approval for this application. This is in response to recurring variances due to Zoning Ordinance inadequacies. If the Board of Zoning Appeals should approve the variance at this time, staff would recommend the following conditions. 1. Wall signs to be measured by 1. 5 square feet to 1 linear foot of business frontage. 2 . Only 1 wall sign per tenant. 3 . No wall sign shall exceed a 200 square foot total. 4 . No roof signs shall be erected on this site. 5. Site shall be limited to one (1) freestanding (pedestal) sign not to exceed 50 square feet and shall identify the site only. No freestanding menu board sign shall be used.
