Hi Alan & Ashley,
Attached you will find the second review comment letter for the Brookhill proffer amendment ZMA.
The comment email from Rosalyn Schmitt with ACPS is included. I have received verbal confirmation from Hal Jones
with VDOT (telephone) that VDOT has no objections to allowing a future curb cut on the north side of the connector
road to accommodate a parking lot for a future high school. VDOT also said that future expansion of the stormwater
facility will be possible. This takes care of the ACPS comments related to the proffer amendment. I have sent Hal an
email asking him to confirm that VDOT has no objections to both requests. Once he responds, this will be all I need to
confirm that ACPS can allow the ZMA to move forward to the Board approval stage.
Take a look at the comment letter, there are a couple of things that still need to be revised in the actual proffer
statement. Let me know if you have any questions or concerns. But once those comments are addressed, you can email
me over a PDF of the proffer statement and I will verify that you can obtain owner signatures and move forward to
scheduling a Board agenda item to get this approved.

Thanks again for all of your hard work on this one, I truly appreciate it. Following up on the voicemail I just left you, I am
emailing to verify that I understand VDOT's position on two questions related to the Brookhill proffer amendment
application and Rio Mills connector road:
Per the Albemarle County Public Schools request, VDOT has no objections to allowing a curb cut on the north
side of the Rio Mills Road connector road. The curb cut location and construction will need to take place at a
future date when/if the school system decides to build a school on the adjacent property. The curb cut location
and design will be subject to VDOT and County staff review for compliance with all applicable standards.
Per the Albemarle County Public Schools request, VDOT has no objections to allowing the school system/future
high school to utilize and expand (if necessary) the Rio Mills Connector road stormwater facility that will be
constructed as part of the road project. Of course, this will be subject to VDOT and County staff review when the
school proposal gets to the plan review stage and will need to comply with all necessary requirements.
If you could respond to this email confirming my understanding on these two topics, I'd appreciate it. Thanks,

I am following up on this application to see if you spoke with Joel about the school system's requests for a curb cut and
ability to tap into the stormwater facility, should a future high school be built next to the connector road. Did we ever
get confirmation that this is acceptable?

I did see these — thank you. I do not see any major issues with these requests, but I wanted to check with Joel DeNunzio
before I replied. I hope to meet with him tomorrow. Additionally, I have had a chance to speak with our RW folks and
we will be providing a "swath" into which the roadway can be built and which Riverbend can dedicate. I'll get additional
details to you soon.

Hi Hal,
I am just touching base on so see if you've had a chance to read over the two questions I listed below.
To be clear, if the curb cut can't be put into the contractor's plans for the connector road, then we don't want that to be
something that jeopardizes the Smart Scale project. I just wanted to see if that was a possibility to include it at this
point.
If Alan dedicates enough land for the initial stormwater pond and easement, would VDOT allow the County to expand
that facility if the school wanted to share it in the future?

Good evening Hal, Alan, & Ashley,
Staff from Albemarle County Public Schools have provided their input on the proposed Brookhill proffer
amendment. Please see the attached PDF for the full email. To summarize, ACPS acknowledges that the connector road
is going to be installed since it is a desire of the BOS, is a proffered improvement, and is a current VDOT project that will
be constructed. They have stated that they can support the potential future high school parcel being reduced in acreage
(as small as 50 acres) and split into two pieces due to the Rio Mills connector road right of way.
ACPS offered the following three suggestions related to the design of the connector road and associated improvements:
Consider providing a pedestrian walkway, tunnel, or crosswalk controlled by traffic lights to mitigate
concerns about access to athletic fields on the north side of the connector road.
Consider providing a curb cut on the north side of the road to allow for future parking for the fields on the
north side of the connector road.
Request a shared use of storm water facilities with the road construction in order to maximize available
acreage of the school site.
My questions for you are as follows:
• Hal: is it possible at this point to have the design build contractor incorporate the curb cut on the north side of
the Rio Mills Connector road to provide access to the northern piece of the school site?
• Hal and Alan/Ashley: are both parties willing to come to an agreement for dedicating an easement large enough
for the shared use of the stormwater facility? My understanding is that the stormwater facility for the road will
be located outside of the road right-of-way in a VDOT owned easement. Additionally, it is still possible to
dedicate an easement large enough for the initial stormwater pond (and future potential expansion so the
school can use it) if that information is provided to the design build contractor. Is this correct?
o Hal, does VDOT have any objections to allowing the County to expand the stormwater facility later and
share its use, so long as the owner dedicates an easement large enough for a future expansion?
