Patterson Department of Zoning 401 McIntire Road Charlottesville, VA 22901 Dear Ms. Patterson, Thank you for the information/documentation you mailed me last month. I have studied the regulations, and as I read them, the appellants have a case to make for a business sign under section 4. 15~3. 1, but I can see no right to appeal based on what appears on page 226, section 34.2, paragraph 3, wherein is stated the Board's right to hear an appeal based on circumstances (topographic, etc. ) which "would effectively prohibit or unreasonably restrict the use of the property" whereby a variance would "alleviate a clearly demonstrable hardship approaching confiscation, as distinguished from a special privilege or convenience sought by the applicant~ . . ° I submit to you that there is no way that NOT having a sign advertising their respective businesses turn-off point over a mile away can be construed as restricting the use of these businesses' property, NOR can there be any way of seeing how these guys were under any "clearly demonstrable hardship approaching confiscation" by not having a sign~ Furthermore' the placement of such a sign can be seen as nothing but the granting of a^ "special privilege or convenience sought by the applicant" inasmuch as Mr. Loeser's Log Cabin business is harldy a drive-by type of enterprise, and a Christmas tree business gets twelve months of commercialization of a corner I drive by several times a day, for a sales period of a few weeks. While I can appreciate any mman~ s quest to earn his living as close to home as possible, I cannot appreciate the casual disregard for a neighbor's right to drive home each day without being reminded of who does what 1 . 2 and 1.5 miles down the road. I hear they're starting to sell advertising space on hot dogs and eggshells. Isn't it great ! No place or space is inviolable -- all is subject to free enterprise economics! Travel plans will keep me from attending the April 10th meeting of the Board' so I would herewith like to submit this letter to all parties concerned to be placed in the file as my protest to the proposed sign placement, on the grounds described above' that this would represent nothing more than the granting of a special 1 . . priveIege to a few at the expense of the many who must drive by each day, forced to wonder at the wisdom of a county that allows its commons to be so despoiled for the sake of accommodating commercial enterprise at the cost of residential retreat.
