Amelia Patterson Zoning Administrator County Office Building 401 McIntire Road Charlottesville.Virginia 22901 March 19,1990 Re: Hendricks Residence-Variance Application Additions and Alterations 2 Lake Road,Farmington Dear Amelia, The following explanation may help to elaborate on the variance application and the determinants af- fecting the proposed location of the addition. In evaluating the site for the proposed addition,the existing sloping topography to the rear of the house precludes locating the addition in this area. Additionally,due to the angled orientation of the existing residence on the lot,it is impractical to locate the addition to the rear and to the west side of the existing residence. In the area where the proposed addition is shown on the site plan,an existing circular drive and extensive existing landscaping preclude locating the addition any further to the east. Moving the proposed addition closer to Lake road(south)would only encroach on areas which should be maintained for possible future alternate septic drain fields. It appears that the literal en- forcement of this section of the ordinance would unreasonably restrict the use of this property,even in its present form. The existing residence was constructed in accordance with an earlier sideyard setback of 10 feet,(the closest existing corner of the proposed building to the sideyard setback is approximately 12 feet);the pro- posed addition does not substantially effect,and in fact maintains the character and existing sideyard boundary of the residence. With regard to other residences in the subdivision,since the original sideyard setbacks in Farmington were established at 10 feet,there are a number of houses with building elements close to a 10 foot setback. There are many other instances in the same vicinity which share similar sideyard circumstances. The Owners request relief from the sideyard setback as presently adopted in order to make the resi- dence habitable for their immediate family members. The addition consists of bedroom and living quarters for their daughter. There is garage space below the living quarters. Because of the narrow configuration of the lot,and the location of the existing residence,it will result in undue hardship,both physically and finan- cially,to attempt to locate the proposed structure in any location other than where it is shown. The Owners sub + :t this request for relief should not be of substantial detriment to adjacent properties,and that the ch• act- of the neighborhood will not be materially changed by the granting of this variance.
