Dear Sir:
This letter is to inform you that on April 10, 1990, during the meeting of the
Albemarle County Board of Zoning Appeals, the Board unanimously approved your
request for VA-90-22.
This variance approval allows relief from Section 30.5.6.2.1 of the Albemarle
County Zoning Ordinance to reduce the scenic highway setback for a new bank from
150 feet to 95 feet from Route 250 with the following conditions:
(1) Building height shall not exceed 35 feet;
(2) Planning staff approval of landscape plan that meets the intent
of the Scenic Highway scenic quality.

ZONING: C-1, Commercial
ACREAGE: 3.183 acres
LOCATION: On the north side of Route 250 west, adjacent to the Ivy Motor
Lodge, just west of Route 678 and the Railroad bridge.
REQUEST:
The applicant requests relief from Section 30.5.6.2.1 of the Albemarle County Zoning
Ordinance, which states:
"30.5.2.2 SA-HIGHWAYS
SA-highways overlay districts are hereby established along the
following highway corridors in Albemarle County for a distance
of one hundred fifty (150) feet on each side of the right-of-
way:
a. U.S. Route 250 from the western corporate limits of the
City of Charlottesville to the western Albemarle County
border. . .
"30.5.6.2 SA-HIGHWAYS
"30.5.6.2.1 No building or structures other than permitted under Section
4.11, except as hereafter provided in the case of certain signs,
shall be constructed within any SA-highways overlay district.
(Amended 12-2-87)"
The applicant seeks a variance to reduce the scenic highway setback from 150 feet to
95 feet, a variance of 55 feet for construction of a new bank. The applicant's justi-
fication for the location is both grading requirements and septic field locations.
A site plan and a special permit for drive-in windows have been submitted, and are
currently under review.
RECOMMENDATION
The proposed septic field and reserve area comprise the rear 4 or so (50-90 feet)
of the property. A graded side slope extends from the septic area to the paved
parking and circulation area. It appears that the building location is most
logical as proposed due to the topography and septic field constraints.

Staff recommends approval for cause:
1. The applicant has provided evidence that the strict application of the ordinance
would produce undue hardship;
2. The applicant has provided evidence that such hardship is not shared generally
by other properties in the same zoning district and the same vicinity;
3. The applicant has provided evidence that the authorization of such variance
will not be of substantial detriment to adjacent property and that the character
of the district will not be changed by the granting of the variance.
Staff recommends the following conditions:
1. Building height shall not exceed 35 feet;
2. Planning staff approval of landscape plan that meets the intent of the Scenic
Highway scenic quality.
