BOX 711, CHARLOTTESVILLE, VIRGINIA 22902 • (804)972-1100 April 6, 1990 Members of the Board of Zoning Appeals C/O Amelia Patterson County of Albemarle Ridge and McIntire Roads Charlottesville, Virginia 22901 Dear Ms. Patterson: The variance request filed by Jefferson National Bank is based on two premises: the Health Department and the topography. First, the Health Department has determined that the most suitable area for the septic fields is away from the stream and up the slope behind the proposed bank. The location has had soil and percolation tests completed and has been approved by the Health Department. The Health Department is also requiring that the septic field areas be undisturbed, i.e. , no grading takes place. In order to accommodate this without a massive cut and retaining wall, it was suggested that the bank ' s building site be moved forward. If the bank stays behind the 150-foot setback, significant cut grading of over 120 feet behind the front of the bank building would have to be done, and an earthen bank at a 2: 1 slope would face 250 West. The alternative to the earthen bank is a combination retaining wall and 2: 1 slope. As the original rezoning file shows, a branch bank was always contemplated for this site, and the majority of other commercial uses were proffered out. It is still believed that a small , brick , one-story branch bank would blend with the character and scale of Ivy. The proposed bank location is 95 feet back from the 250 West right-of-way. This is over twice the setback distance of the building farthest from the road in Ivy (the gas station) as well as the other properties which are about 35 feet back (Ivy Store, 7-Day, Duner' s, clothing store) . The bank' s site is also elevated above the roadway, rendering it less intrusive. All the rest of the other Ivy buildings are level with the Route 250 roadway.
