VA-90-23, Tax Map 32, Part of Parcels 36, 36F, & 42
Dear Sir:
This letter is to inform you that on April 10, 1990, during the meeting of the
Albemarle County Board of Zoning Appeals, the Board unanimously approved your
request for VA-90-23, subject to the following conditions:
(1) Each tenant be allowed a maximum of one (1) business wall sign;
(2) The size should be based on 1.5 square feet of wall signage per one
(1) linear foot of building, not to exceed 200 square feet of signage
per tenant.
This variance approval allows relief from Section 4.15.3.7 of the Albemarle County
Zoning Ordinance to allow 1.5 square feet of wall signage per one (1) linear foot
at building frontage, not to exceed 200 square feet of signage per tenant, for a
maximum of 556 square feet of wall signage, a variance of 356 square feet.

OWNER/APPLICANT: McKenzie Properties, Inc.
TAX MAP/PARCEL: 32/36, 36F and 42 (parts of)
ACREAGE: 5. 5 acres
ZONE: PDSC, Planned Development Shopping Center
LOCATION: On Timberwood Boulevard, approximately 200
feet northeast of the intersection of
Timberwood Boulevard and Route 29 North
(Also known as Forest Lakes Shopping Center)
REQUEST:
The applicant requests a variance from Section 4 . 15. 3 .7 of the
Albemarle County Zoning Ordinance. This section states:
"4. 15. 3 .7 . . .
Business signs, wall: Provided . . .
(b) the aggregate area of all such signs shall not exceed
two hundred (200) square feet. . . "
The applicant is requesting a variance to allow 1. 5 square feet
of wall signage per one (1) linear foot of building frontage,
not to exceed 200 square feet of signage per tenant, for a
maximum of 556 square feet, a variance of 356 square feet.
The applicant's justification is the variance is needed to
allow the shopping center tenants to properly identify their
businesses.
RECOMMENDATION:
This has been a commonly recurring variance. The applicant does
possess a hardship in that the zoning ordinance does not provide
for adequate wall signage for property zoned PDSC, Planned
Development Shopping Center. The applicant's request will
will be in compliance with what Zoning Staff intends to
recommend for amendment to the sign regulations. This will
go to public hearing for work sessions within two (2) weeks.
In addition, it is consistent with what has been approved by
variance for Riverbend Shopping Center, Rio Hills Shopping
Center, etc.
The application should be approved for cause:
(1) The applicant has provided evidence that the strict
application of the ordinance would produce undue hardship.
(2) The applicant has provided evidence that the authorization
such variance will not be of substantial detriment to
adjacent property and that the character of the district
will not be changed by the granting of the variance.

Should the Board of Zoning Appeals find cause to approve this
request, staff recommends the following condition:
(1) Each tenant be allowed a maximum of (1) business wall sign
(2) The size should be based on 1.5 square feet of wall
signage per one (1) linear foot of building frontage,
not to exceed 200 square feet of signage per tenant.
