Dear Amelia:
Attached please find an application for variance for TM 55-
109A and -110.
The owners of the property have contracted to sell the two
parcels in question, together with the abutting parcel to the
rear, TM 55-109, to the current tenant in the office building.
As you can see from the attached plat (Exhibit 1 ) , the existing
building is located approximately 14 feet from the right of way
of U.S. 250, within the scenic highway overlay district.
The property was acquired many years ago by the father of
the current owners. The existing buildings and property lines
were established many years ago, prior to the current owners'
acquiring the property and prior to the application of the either
zoning or subdivision regulations to the property.
The proposal is to expand the building by adding an addition
on the easterly end of the existing building. See Exhibit 2. As
you can see from the architect' s plan, the front of the addition
will align with the front of the existing building. The building
will not encroach on the side yard to the east or the rear yard
to the south. It is proposed that the entire façade of the
building, including the existing portion, be reconfigured so as
greatly to improve its appearance. See elevations attached as
Exhibits 3 and 4. Parking is to be maintained in its current
location. It is understood that a site plan will have to be
prepared and reviewed in accordance with Section 32 of the
ordinance.
It is our position that, because of the shallowness of the
lot, no development can be made of the property without
encroaching on the scenic highway overlay district and that
therefore the terms of the scenic highway overlay district
unreasonably restrict the use of the property so as to impose a
hardship on the owner of the property. This hardship is directly

related to the preexisting configuration of the lot and so is
not shared generally by other properties in the same district and
the same vicinity. Because the proposed addition will simply
continue the line the existing building and continue the existing
parking, it is our position that the variance proposed will not
be of substantial detriment to adjacent property and will not
change the character of the district. In fact, we believe that
the proposed addition will substantially improve the character of
the property by reason of the substantially improved appearance
of the façade and application of the design requirements,
including, but not limited to, landscaping, of the site plan
section of the ordinance.
