I would like to confirm in writing that there was never any intention by myself or anyone in our Department to question your credibility on the information given concerning the Blue Ridge Run flood area or road improvements for Route 641. Your letter was addressed to the Board of Zoning Appeals as written. The staff comment to your letter was that the existing house nor the proposed addition were in the 100 year flood plan as defined by HUD by which our building requirements are based. Staff comment concerning Route 641 was that there are no current plans nor any within the six year plan for road improvements in this area. May 2 , 1990 Dear Ladies and Gentlemen; This letter is regarding the request for relief from Section 10 . 4 of the Albemarle County Zoning Ordinance, applied for by Timothy and Deborah Ritchey, in order to construct a garage 27 feet from the right of way of Route 641. As my wife Kathleen and I understand it, the variance may possibly be denied if adjacent landowners can provide just cause or good reason why the variance should not be granted. We are not clear, however as to what constitutes just cause or good reason. For a number of reasons we are opposed to the granting of the proposed variance in the assumption that the granting of this type of variance is a privilege, and not necessarily a right. Mr. and Mrs. Ritchey own slightly less than one acre of land. On this property there are now kept outside four large malamute dogs in pens , three dogs of mixed breeds , several cats , a pony, a goat, and a number of fowl such as chickens and ducks . Inside the house are kept an undetermined number of dogs , rumored to be more than a dozen. There seems to be no real provision made to dispose of the sizable quantity of waste these animals produce, and it has always been unclear as to where it goes . We understand there are no county ordinances restricting the number of animals or outbuildings one can have on less than one acre, but we believe some natural restrictions should apply. It seems to my wife and myself that if the Ritcheys ' are restricted from building on one side by a water source and property line, restricted on another side by a septic field, restricted on another side by a state road, and further restricted by existing dog pens , a pony pen and an outbuilding that was constructed last year, we feel that they have filled their lot with the maximum that it can and should hold. Our concern is that the propose' garage will not be used to house vehicles or equipment, but will merely be a makeshift kennel , again with no provision for disposal of waste. As the existing house is quite close to the road, the cats and dogs that are in the yard spend more than a little time in the road already. Both my wife and I on several occasions , have had to come to a full stop in the road as an uncontrolled dog or cat ran into the road. On such a crowded lot, the construction of yet another building in such extreme proximity to the state right of way is to us an undesirable thing. L __ 7 We also believe that reduction of adjoining property values, due to the already overcrowded conditions described in this letter, constitutes a very real and good reason why the variance should not be granted. They, apparently are sure the request will be granted, as the lumber for construction of said garage was delivered in January and has laid in the yard next to the two unused, unlicensed vehicles ever since.
