Subdivision on 7/19/89 consisting of 7 lots as shown on
the attached plat. The owner neglected to record the plat
within 6 months of the approval date causing the approval to
lapse. In the meantime 10 . 3 . 1 of the zoniq ordinance was
amended 11/8/8 ( to impose _the 31 acre aggregate acreage (over)

Application for a Variance
Dear Amelia:
This letter is to follow up on the conference that David
Carr and myself had with you on Wednesday, April 11, 1990.
During our conference Mr. Carr was able to elaborate in
more detail on the justification for the requested variance. I am
setting forth in this letter the specific reasons for the
requested variance:
1. It would work a hardship not to approve the
Family Subdivision in its existing form
because a lot of time and money was spent
coming up with a fair division of the
property in order to treat all six of Mr.
Carr' s children equally

2 . The typography of the land lends itself to
this Family Subdivision. The southern most
part of each plated lot consists of high
ground well suited for building sites. Each
lot drops off to the lower ground adjoining
the creek shown as "Jumping Branch" and this
also gives each child frontage on the creek.
3 . In laying out the lots shown on the plat
consideration was also given to the existing

easement along an old roadway. The lots were
laid out the way they are shown in order to
ensure use of the access easement by each of
the lots.
4. Mr. Carr's intention is to convey lots 2
through 7 to his 6 children and to convey lot
1 to his wife, Martha J. Carr. Mr. and Mrs.
Carr live in the main house on land which
adjoins lot 1 and is referred to on the plat
as Tax Map 44, Parcel 27A. Their intention
is to maintain lot 1 as an unimproved lot so
as not to interfere with their view from
their existing residence as they look
westward to the Blue Ridge Mountains.
I would appreciate it if you would attach this letter to
the Application for a Variance in your file. I appreciate your
meeting with us and your consideration of the variance request.
