Dear Mr. Gale:
This letter is to inform you that on June 12 , 1990, during the
meeting of the Albemarle County Board of Zoning Appeals, the Board
unanimously approved your request for VA-90-39 .
This variance allows relief from Section 10. 4 of the Albemarle
County Zoning Ordinance to reduce the minimum frontage along a
public road from 250 feet to 221 feet in order to create a 2 acre
parcel along Route 610.

OWNER/APPLICANT: Charles and Betty Holloway
TAX MAP/PARCEL: 63/33
ZONING: RA, Rural Areas
ACREAGE: 30 acres
LOCATION: Located on the south side of Route 610,
approximately .8 mile east of the intersection
with Route 20 north.
REQUEST:
The applicant requests relief from Section 10.4 of the Albemarle
County Zoning Ordinance, which states:
"Area and Bulk Regulations:
Minimum frontage
existing public roads. . . 250 feet. "
The applicant is requesting a variance to reduce the minimum
frontage along a public road from 250 feet to 221 feet, a 29 foot
variance, in order to create a 2 acre parcel along Route 610.
Separate entrances are proposed for the new lot and the residence.
Applicant's justification includes the following:
1. The existing paved driveway has been in use for 28 years.
2 . The Virginia Department of Transportation will not approve the
existing entrance to be used as a joint access easement for
both parcel A and residence, due to inadequate sight distance.
3 . The Virginia Department of Transportation has approved a
separate entrance for parcel A and is not recommending
applicant to share this entrance because of topographic
problems.
RECOMMENDATION
Approval of this variance would allow one (1) additional entrance.
It is a general goal to reduce side friction on public roads by
consolidating entrances. However, this goal could only be
accomplished if Mr. Holloway were to close the existing driveway
and create a joint access easement using the new approved entrance
location for parcel A.
Staff has conducted an on site inspection and agrees with the
applicant and Virginia Department of Transportation that a
topographic hardship does exist. If the applicant were required
to close the existing driveway and realign with the new entrance,
he would have to grade 150 feet to 200 feet of area that appears
to be 25% or greater in grade. This hardship does not appear to
be shared by other properties in the vicinity nor does it appear
that authorization of such variance will be of a detriment to
adjacent property.

However, the location of parcel A is self imposed by the
applicant. There appears to be additional frontage east of the
applicant's house that could be used to create another parcel.
Therefore, staff recommends denial for cause.
1. The applicant has not provided evidence that a strict
application of the ordinance would produce undue hardship.
