Ward Sims & Sallie Twyman Sims 985 Old Garth Road Charlottesville, VA 22901 RE: Application for a variance from Section 10.4, Albemarle County Zoning Ordinance We are requesting a variance from Section 10.4, Albemarle County Zoning Ordinance, specifically with reference to the 25 foot sideyard setback provision. As noted on the surveyor's plat worksheet attached to this appli- cation, the proposed addition of a living room, dining room and covered porch to our residence, on the south side, encroaches within the setback area from the southeast corner of the existing structure, where the 25 foot setback line touches, to a point not closer than 7.3 feet to the property side boundary line, such point being the southeast corner of the proposed covered porch. Architect designed additions are proposed to both ends of the existing structure in order to provide increased living space to the existing small cottage home. The present building was constructed in 1968 and located on the lot in the only building site available in the narrow lot that provided space for a septic system and road access. At the time of construction no zoning ordinance requirement existed for sideyard setback. With the present setback of 25 feet and the location of the septic system, we cannot expand on the south side of the structure without encroaching in the sideyard setback area. Construction is presently underway with approved plans under Albemarle County permit. Work has developed only on the north side of the structure, since footings were dug on the south side pending the survey to determine the actual 25 foot sideyard setback area. It was not anticipated that the proposed south side addition would encroach in this area. The adjacent property owner, M. Jack Rinehart, Jr. , has reviewed the proposed addition within the setback area with us and has indicated he will offer no opposition to the variance as proposed utilizing the surveyor's plat specifications as to the foundation footings for the addition. The adjacent property owner on the opposite side, Nicholas Duke, has also reviewed the proposed additions with us and has indicated his approval. Based on this application, and in accord with the property plats and architect plans for the proposed addition as specified, recognizing that portion which falls into the side yard setback area, we urge your favorable consideration of this variance request.
