STATEMENT FOR THE RECORD

REQUEST FOR VARIANCE FROM SECTION 10.4 OF THE ALBEMARLE COUNTY ZONING
ORDINANCE
1. It is respectfully requested that we be allowed to construct a
standard, detached, two-car garage (24 x 24) on our property located at
103 Juniper Lane in the Cedar Hills Subdivision of Charlottesville.
2. When we purchased the house on 1 August 1989, our intention was to
build a garage on the property. Neither the previous owner, nor the real-
estate agent, informed us of any zoning restrictions which would prohibit
the construction of a garage. In all of our preliminary discussions with
various individuals, including two employees of the county, we received no
indication that there would be a problem with our request. Finally, by way
of background, we have had our vehicles sheltered in a carport in our
previous home in Northern Virginia for the past 20 years.
3. While our property consists of 1.14 acres, the site on which we
intend to construct the garage is the only feasible area for doing so.
There simply is not sufficient space on the other side of the house for
any construction. Even if construction were feasible in this area, it would
require variances both in front and on the side. The only other potential
area for construction would be in back of the house. The cost for construction
there would be astronomical; the garage would be unsightly; and the driveway
to get to the garage would be extremely long and expensive. More important,
however, is the fact that a sceptic field is located in that area. Consequently,
building anything there would be a health hazard and not environmentally sound.
4. If the garage had been constructed when the house was originally built,
I believe that it would have been undoubtedly located precisely where we
would like to build it. We intend to acquire the services of a professional
architect to ensure that the garage blends into the existing landscape
arrangement. My oldest son, a 5th year architecture student at Virginia Tech,
has also provided us with a scheme to ensure that the garage fits into the
surrounding environment.
5. Juniper Lane is a relatively short, cul-de-sac street. My house is
located at the "top" of the cul-de-sac. There are three other houses located
on Juniper Lane, Each of them has a garage. The construction of a garage on
my property will, therefore, be in concert with the other three houses on
the street. I have discussed my plans to build a garage with all three
neighbors. None have any objections. The garage will not only increase the
value of my property, but it will also, I believe, increase the value of their
homes as well.
6. The present arrangement for parking my vehicles is most inconvient
to me, my neighbors, my guests, and anyone driving around the cul-de-sac.
Although my automobiles are compact, the nature of the circle on the cul-de-sac
is such that there is very little room to drive around the circle in front
of my house when zny vehicles are parked there. This causes a hardship for
my neighbors, those who transit the area, and for my guests. Snow plows
cannot adequately plow the circle in winter unless my vehicles are moved.
In fact, because of these circumstances last winter I had to shovel snow
around the circle by hand on a number of occasions. The only other place
to park my vehicles in the vicinity would be adjacent to my neighbors' homes.
7. As I mentioned above, we have had shelter for our vehicles for the
past 20 years. My employment at the Federal Executive Institute requires that
I make it into work every day when one of our programs are in session (there are
nine four-week programs held throughout the year) regardless of the weather.
Having a sheltered vehicle would facilitate my getting to work. More
importantly, my wife and I have elderly mothers, both of whom have heart
conditions. Since they visit us several times a year it is most helpful for
them to be able to get into a sheltered vehicle when required.
8. In view of all of these factors, it is requested that approval
be granted to permit construction of a garage on the designated site.
