We fully support the spirit and purpose of this ordinance. The points which we raise to support our application, we feel do not contradict these mutually held goals, but it is rather the specific geographical conditions of this property that lends it to special consideration. The three households involved, and which currently reside on the property, have agreed on keeping the nature of this land as it presently is: Residential and Agricultural. To guarantee this, we will have restrictive covenants which will prohibit any further subdivision than is currently planned. Our proposal does not increase the number of households. The same number of households have inhabited this land for, at least, the last twelve years. In fact, two of the families have resided on the premises for several years (5 and 8 years). We are dedicated to maintaining the agricultural aspects of the property. A functioning barn and pasture will enable us to support livestock. In addition, this proposal does not in any way alter the character of this or adjacent properties. Our claims on the basis of hardship are as follows (see enclosed property survey with a graphic explanation): 1) Critical slope areas comprise approximately 6 acres of the property. 2) The flood plan comprises at least 4 acres. 3) The 100 foot setback along the creeks and river delete approximately 4 acres(that are not in the flood plan). 4) The powerline and associated easements further remove approximately 5 acres. Taken together this would remove approximately 19 acres due to the particular site conditions of this property. This would leave approximately 21 developable acres. 5) Our option to buy agreement expires on June 25, 1990. 6) After consultations last fall with the appropriate county officials, we proceeded to acquire survey information, legal consultation and to fulfill the requirements of financial lending institutions. After these efforts were intiated, we were informed of the inhibiting zoning ordinance. We feel this does cause a certain financial hardship. 7) In addition, we wish to suggest what might be called an "emotional hardship". Having resided on this land; made homes for ourselves and children, and established very strong committee ties, it is certainly not our wish to move. It is our sincere desire to remain on this land. We feel, because of these special site conditions and our agreement with the spirit of the county ordinances, in retaining the rural nature of this part of Albemarle County, this gives us a st ng case for serious consideration for a variance.
