This variance allows relief from Section 21.7 . 1 to allow the sign setback to be reduced from 30 feet to 10 feet subject to the following conditions: 1. The height of the sign be restricted to 8 feet, and 2 . No roof signs allowed on the building. If you have any further questions, please do not hesitate to contact me. TAX MAP/PARCEL: 61W/02-2A ZONING: HC, Highway Commercial ACREAGE: 3 . 1 acres LOCATION: Located on the east side of Pepsi Place, 0. 2 mile southeast of Greenbrier Drive. REQUEST: The applicant requests relief from Section 21.7. 1 of the Albemarle County Zoning Ordinance, which states: "21. 7 MINIMUM YARD REQUIREMENTS 21. 7 . 1 Adjacent to public streets: No portion of any structure except signs advertising sale or rental of the property shall be erected closer than thirty (30) feet to any public street right-of-way. " The applicant is requesting a reduction in the front yard setback requirement from 30 feet to 7 feet, a variance of 23 feet, to erect a freestanding business sign. The proposed sign will be 50 square feet in area, 14 feet in height. The sign material is flexface vinyl and aluminum. The applicants' justification includes the following: 1. The location requested at the front of the site is the only area not encumbered by easements. 2 . The proposed sign will meet the criteria for setback and square footage that is being considered for the new sign regulations. RELEVANT HISTORY: Staff recognizes that each variance is reviewed on its own merits, and is not its face, precedent-setting. The following history is provided for information: The following are variances that have been granted to the 30 foot setback requirement from a right-of-way in this area. 1. VA-88-04, Investor Savings Bank, Tax Map 61W, Parcel 02-B1, A 30 foot variance was approved to reduce the setback for a freestanding sign to 0 feet from the right-of-way. Conditions: 1) No roof signs allowed on the building 2) Maintain proper sight easement. Page 2 Staff Report - VA-90-52 2) VA-88-91, Tiger Fuel, Tax Map 61W, Parcel 02-B3 , a 29 foot variance was approved to reduce the setback for a freestanding sign to 1 foot from the right-of-way. Conditions: 1) No roof signs allowed on building. 3) VA-87-47, Exxon, Tax Map 61W, Parcel 02-C2 , A 29 foot variance was approved to reduce the setback for a freestanding sign to 1 foot from the right-of-way. RECOMMENDATION The one aspect of this sign request that will not meet the standards that will be recommended in the changes to the sign regulations is the height of the proposed sign. The staff recommendation for site indentification sign height will be 6 feet to 8 feet. Staff realizes that because of topographic variations in this region and unfore seen circumstances, that some discretion will be needed in the proposed height regulations. In this case, the proposed parking area for the adjacent property will obscure the view of a 6 foot indentification sign from Greenbrier Drive. In staffs' opinion, this case would qualify for an increased height. This request meets the criteria that is being proposed for the new sign regulations. Therefore, staff recommends approval for cause should the Board of Zoning Appeals find cause to support this variance. Staff would like to recommend the following conditions: 1) That roof signs not be allowed on the building.
