Dear Gentlemen:
This letter is to inform you that on August 14 , 1990, during
the meeting of the Albemarle County Board of Zoning Appeals, the
Board approved your request for VA-90-53 subject to the following
conditions:
1 . Any future change in usage or tenancy will require the
installation of additional parking spaces consistent
with such new use, and
2 . `I`hat this variance does not alter the site plan.
This variance approval allows relief from Section 4 . 12 . 6. 6. 2 to
reduce the parking requirements for proposed elderly multi-family
housing from 38 spaces to 30 spaces.

ZONING: PRD, Planned Residential Development
ACREAGE: 3 . 1 acres
LOCATION: Off the west side of Route 240 behind The
Meadows, and north of Henley and Brownsville
Schools.
REQUEST:
The applicant requests relief from Section 4 . 12 . 6. 6.2 of the
Albemarle County Zoning Ordinance, which states:
"Dwelling, Multi-family dwelling for the elderly: one and
one-quarter (1 1/4) spaces per unit plus one (1) space
per employee on the major shift. "
The applicant requests reduction in parking requirements for a
proposed 30 unit multi-family building, from 38 spaces to 30
spaces. This amount to a reduction from 1 1/4 spaces/unit to 1
space/unit. The site plan has already been approved The lender
(HUD) has requested a change in order to reduce project costs.
The applicant's justification includes:
1. The Meadows, which complies with the parking regulations, has a
significant surplus of parking. With 12 years of comparable
experience, they have found that at no time have more than 37%
of residents owned cars;
2 . They city of Charlottesville Zoning Ordinance requires 1/2
space/unit for multi-family elderly or low-income housing;
3 . This parking reduction will result in less impervious surface
in the drainage area.
RECOMMENDATION
Staff has conducted a causory review of this parking requirement
to determine if it is unreasonably restrictive There are very few
comparable projects within Albemarle County. One project, Arbor
Crest Apartments found the requirement to be adequate. This
requirement was the same in the earlier, 1977 Zoning Ordinance.
Staff could find no other variance requests. We therefore
conclude that these regulations are satisfactory.

We are certainly sympathetic to the applicant's predicament, and
are supportive of the project. However, the hardship is not
unique to this property and does not unreasonably restrict its
use.
Staff recommends denial for cause:
1. The applicant has not provided evidence that the strict
application of the ordinance would produce undue hardship;
2 . The applicant has not provided evidence that such hardship
is not shared generally by other properties in the same
zoning district and the same vicinity;
3 . The applicant has not provided evidence that the authorization
of such variance will not be substantial detriment to adjacent
property and that the character of the district will not be
changed by the granting of the variance.
The result of denial is that these additional spaces (8) would not
be subsidized by HUD. Instead, their costs will be transferred to
the residents.
