MICHAEL ATKINS (804) 977-8190 GREGORY M.JOHNSON August 14, 1990 WADE A.JACOBSON Board of Zoning Appeals 401 McIntire Road Charlottesville, Virginia 22901 RE: VA-90-55, Tax Map 45B1, Parcel 5-C4 Dear Sirs: My law firm represents Delfar Land Trust, the owner of the subject property, and Automart USA-Daihatsu, applicant, in connection with the above-referenced variance application. Automart USA is requesting relief from Section 21.7 . 1 of the Albemarle County Zoning Ordinance which requires signs to be erected no closer than 30 feet to any public street right-of-way. Automart is requesting a thirty-foot variance in order to erect a free standing business sign 0 feet from the right-of-way of the frontage road. The exact location of the sign is 85 feet from the edge of Route 29N and 713 feet ,from the center of the future frontage road access and stoplight. An interim connection is currently located in front of the subject property, but is to be closed subsequent to the development of the property located south of the subject property. Owners of the property adjacent to Automart include Jim Darnell, trading as The Garden Patch, to the North and A.T. Williams Oil, Co. , to the South. A copy of the drawing of the property located along this section of Route 29N is attached hereto as Exhibit A. A copy of the plans for the subject property, which also indicates the location of the proposed sign, is attached hereto as Exhibit B. The proposed sign is 98 square feet in size and 25 feet 10 inches in height, with the material makeup being flexface vinyl and aluminum. A copy of the drawing of the proposed sign is attached hereto as Exhibit C. In support of the above-referenced application for a variance, I submit the following as evidence of undue hardship as required by Section 34 .2 of the Zoning Ordinance. Strict application of the ordinance would require Automart to erect the sign 30 feet from the right-of-way of the frontage road. This would require that the sign be erected no less than 100 feet Board of Zoning Appeals August 14, 1990 Page 2 from Route 29N, which is more than double that for other property owners along Route 29N. Taking into consideration the distance from Route 29N and the location of future frontage road access and stoplight, the visibility of the sign if it were erected as required by the Zoning Ordinance would be greatly reduced. This reduced visibility would result in fewer automobile sales because potential customers would be discouraged from visiting Automart due to their inability to locate Automart in time to make the turn onto the frontage road. Pictures of the subject property taken from various locations on and around the subject property are attached hereto as Exhibit D. This hardship is not shared by either the adjacent property owners or other property owners in the same vicinity. The subject property is located farther from Route 29N than any other property abutting the frontage road. In addition, other properties in the vicinity of the subject property do not even abut a frontage road. Consequently, by right, most property owners in the same vicinity are entitled to erect their signs significantly closer to Route 29N than Automart. The authorization of this variance will not be of substantial detriment to the adjacent property. In fact, all adjacent property owners support this variance request. Copies of letters from adjacent property owners who support the above-referenced application are attached hereto as Exhibit E. Another factor I would ask you to consider is the traffic hazard which would be created along this section of Route 29N if the sign were to be erected as required by the Zoning Ordinance. As you can see, the distance from the future frontage road access and stoplight to the sign is well over 200 yards. By erecting the sign at the point closest to Route 29N you would allow north bound traffic maximum visibility of the proposed sign which will reduce the number of traffic accidents and other traffic problems resulting from potential customers having to search for the location of Automart from such a great distance.
